Chief Justice Roxane George this afternoon ruled that 33 is the majority for the purposes of  carrying a vote of no-confidence in Parliament.

The judge’s ruling was a major setback to the APNU+AFC’s hope of reversing the 33 to 32 vote which saw its government collapse on December 21, 2018.

After having earlier upheld the disputed vote of Charrandass Persaud, the judge said that 33 was the majority. Through its lawyers the government had argued that the majority should be an absolute one and in this case it should be 34, an argument that had been pilloried in many circles.

The judge today said that the court considered what is a majority of all elected members and in Guyana’s case the majority would be at least 33.

“At least 33 votes must always be obtained regardless of the voters present”, she said.

Attorney General Basil Williams then asked the court for a stay and a conservatory order to preserve the status quo. The judge refused this and advised him to take the matter to the Court of Appeal.

A 90-day clock has been ticking since the December 21 vote for the holding of general elections. To date the government has not recognized this neither has the Guyana Elections Commission shown any sign of observing it.

Today’s ruling by the judge will further weaken the government’s challenge to the validity of the motion of no confidence.

The coalition government has legal rights to go to the court of appeals or to use all legal avenues available to them. When all avenues are frustrated, then the election date will be set. I foresee election in 2020 when the election is constitutionally due.

While the Judge's ruling is welcome, it's worrisome that 41 days have passed since the NCV. That's nearly a half of the 90 days wasted. The honorable thing for Granger to do is to ask Jagdeo's cooperation to vote in parliament for an extension of 60 days from the March 19 election deadline. If PNC+AFC insists on appealing the Judge's ruling, they clearly want to hang on to power at all cost. The Appeals Court and the CCJ may very well uphold Justice George's ruling. What will Granger say then?

I am speaking of legal avenues that are available and how the coalition government may use them to their advantage. I said the same when the PPP was challenge with Granger's appointment of "fit and proper" GECOM's Chairman, Patterson. I wish I know what the hell you are talking about.

Pnc had the advantage, their supporters were like a cancer throughout the system. The poll workers, the counters, the army, the police etc.  Maybe PPP deserve to lose as they did nothing to rectify this imbalance. 

We may not agree with the Chief Justice's ruling but we must respect it. We cannot denigrate our institutions, this is even more urgent in reference to the juduciary, it is the final and best repository for truth, the bedrock on which a civilised society stands. If we lose our institutions, we lose our country. Having said that, I submit that a decision of this unprecedented national implication and importance is screaming out for certiorari (certicification). An appeal should not be in lieu of political upmanship but for posterity. The CCJ put the third term phenomenon to complete sleep and end, these questions need to put to the CCJ so we can put them to sleep.

The Chief Justice is the only educated and sane black person in Guyana. The entire PNC tribe tried to confuse the flock and exposed their ignorance in Simple Maths.

CCJ may refuse to listen to this case so the PNC should stop clinging to power and respect the will of the people and their representatives.
