Guyanese,

The Government, since the passage of the no-confidence motion in the National Assembly on 21st December 2018, has respected the decisions of the Courts and upheld the Constitution.

We challenged the validity of the no-confidence motion and defended the challenge to the constitutionality of the appointment of the Chairman of the Elections Commission.

The legal processes were neither frivolous nor aimed at delaying the consequences of the no-confidence motion.  They sought to clarify and interpret the Constitution and to ensure that General and Regional Elections would be conducted on the basis of a credible list.

I have complied with the rulings of the Courts, upheld the Constitution of Guyana and respected the National Assembly at all times.

I engaged the Elections Commission from February 2019 repeatedly. I insisted that credible elections be held at the earliest possible time. Credible elections are essential to representative democracy.

Guyanese, The Chairman of the Elections Commission Justice Claudette Singh, wrote me last Thursday, 19th September 2019, indicating that “the Guyana Elections Commission will be able to deliver credible elections by the end of February 2020”.

I convened a meeting of available Cabinet ministers that very day, within hours of receiving her advice, to discuss the timeline provided to me by the Chairman.

A second meeting of the full Cabinet was held yesterday, 24th September 2019, when all members accepted the advice provided by the Chairman of the Elections Commission.

Cabinet ministers also benefitted from the advice of Attorney General and Minister of Legal Affairs Mr. Basil Williams and were guided by the need to adhere scrupulously to the advice of the Elections Commission.

I met Chairman of the Elections Commission, Justice Singh, this afternoon Wednesday 25th September, when she discussed the statutory timelines for the upcoming General and Regional Elections

Guyanese, Guyana will observe its 50th anniversary as a Republic on Sunday, 23rd February 2020. The following day, 24th February 2020 will be a national holiday.

I am pleased to announce that, after discussions with Chairman of the Elections Commission and with my Cabinet, the earliest possible date for the holding of General and Regional Elections will be on Monday, 2nd March 2020.

The Constitution at Article 106 (7) states, “Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly shall by resolution supported by not less than two-thirds of the votes of all the elected members of the National Assembly determine, and shall resign after the President takes the oath of office following the election”.

The extension of a period beyond three months for the holding of an election is related to the Elections Commission’s readiness to hold the elections. The Government of Guyana must, as a consequence, return to the National Assembly to request an extension. The National Assembly reconvenes on 10th October 2019.

The President is required to both dissolve Parliament as provided for in the Constitution at Article 70 (2) and the ten Regional Democratic Councils as provided for in the Constitution at Article 73 (2).

The Constitution at Article 61 states: “An election of members of the National Assembly under Article 60 (2) shall be held on such day within three months after every dissolution of Parliament as the President shall appoint by proclamation.”

The Constitution at Article 70 (2) states further that: “The President may at any time by proclamation dissolve Parliament”. The Constitution at Article 73 (2) provides that: “Elections of members of regional democratic councils shall he held and the councils shall be dissolved at such times as subject to paragraph (3), the President may appoint by proclamation.”

Guyanese can now look to the Elections Commission to conduct credible elections within the timeframe prescribed.

Guyanese, We are on the right path to preserve our precious parliamentary democracy.

Let’s wait and see the next move. I am not surprised that he showed the notorious Claudette Singh that he will call election whenever he wants to. This man Granger is a total vagabond, however, it was also Jagdeo that enabled him.

Granger government was successfully defeated by a no confidence vote in parliament in December 2018; hence elections must be held within three months after that date.

Due to the legal challenges in 2019 and the decision of the CCJ upholding the December 2018 no confidence vote; elections must be held within three months from the 2019-CCJ decision.

In that regard; the president and cabinet should have immediately resign; after the decision was made by the CCJ. The president then remain in office; in a caretaker position; and focus on conducting the elections.

Article 106 (7) could then apply if the caretaker government can secure in parliament a minimum of two thirds of all MPs.

Article 70 (2) and Article 73 (2) are relevant when the government has not been defeated by a no confidence vote in parliament.

The best way to survive an accident is to avoid one. The PNC does not have the reputation or numbers to win elections in Guyana so they are only in this position where they can abuse the laws of Guyana as well as the will of the people because some people who forget that the PNC has always been a usurper gave them the license to do so in 2015. Nothing has changed with how the PNC operates and the information era doesn’t seem powerful enough to shield Guyanese from the PNC wickedness.

I told you people a while ago, Granger has been hoodwinked!  In the end, they would have served out their full term.  

Pretty clear they will rig the election, and will get away with it.

That 95% is like Trump’s 98%. They represent about 30% of the entire population.

I must add something to what I wrote above. By no means are the PPP saints. They have had their share of malfeasance. I know Indians who were personally and professionally targeted by the PPP and Jagdeo in particular. I have no issues with those people being against the PPP especially with Jagdeo as it’s engineer. It is the others who got fooled by the wine down ‘vote like a boss’ nonsense which caused them dance all the way to their demise.

How misleading, the president did not set an election date, he fooled the people again in buying more time. Parliament supposed to be dissolved, he is shifting the blame and responsibility unto parliament for them to set a date, "that is new"  so if the PPP refuse to attend parliament then they will get the blame for not setting election date, this is a political TRAP.

 The PPP MUST refuse to sit in parliament and must not extend the date, let the ABC, UN see how corrupt the PNC/AFC/APNU behaving.

Jagdeo: PPP will not be blackmailed, will not return to Parliament

Opposition Leader Bharrat Jagdeo Wednesday evening declared that the opposition People’s Progressive Party (PPP) will not return to the National Assembly to legally extend the life of the Government.

“The only reason they want us to go back to Parliament is to give legal coverage to the illegalities they have committed over the past year,” Jagdeo told the News Room.

In an address to the nation, President David Granger announced March 2 as the earliest possible date for elections but sought to suggest that date is conditional upon the approval of an extension by the National Assembly.

“The extension of a period beyond three months for the holding of an election is related to the Elections Commission’s readiness to hold the elections.

“The Government of Guyana must, as a consequence, return to the National Assembly to request an extension,” the President stated.

But Jagdeo said this is another falsehood and the PPP will not be blackmailed into attending the National Assembly.

He said GECOM’s readiness to hold elections and the President’s discharge of his constitutional responsibility are in no way linked.

The Parliament is currently on recess and will resume on October 10 after which the Government can set a date for a Parliamentary sitting. But Jagdeo told the News Room that the PPP will not attend.

The Constitution mandates elections within three months after the passage of a No-Confidence motion however, the Government launched legal challenges to the passage of the motion.

Guyana’s final court of appeal, the Trinidad-based Caribbean Court of Justice, ruled on June 18 that motion was validly passed.

As a result, it indicated that the three-month constitutional deadline from elections began on June 18 and hence elections were due on September 18.

It means the Government has already surpassed the date within which it could have gone to the National Assembly to request an extension for the holding of elections and hence an extension to the life of the Government.

Jagdeo said the President’s address to the nation was replete with misrepresentation and lies, where the President presents himself as a defender of constitutional rule when he has been “the primary source of unconstitutional rule in the country.”

Jagdeo also took issue that the President did not definitively declare an elections date, instead saying that March 2 was the “earliest possible date.”

“We are no clearer that definitely March will be or will not be elections or it is just another of Granger’s game,” said Jagdeo.

The Coalition partner, the Alliance For Change (AFC) has acknowledged March 2 as the date the President has set for elections.

March 2 is DEFINITE date for elections – President

 

President David Granger on Thursday confirmed that March 2, 2020, is the definitive date on which he intends to proclaim general elections.

The President spoke to reporters at the sidelines of an event at the Cyril Potter College of Education and confirmed the date following speculation from many that the language he used was not clear.

The President, in an address to the nationWednesday night, said that the “earliest possible date” for elections is March 02.

The Opposition People’s Progressive Party (PPP) and others took issue with the language, saying that Guyanese were “no clearer than they were before.”

“His address has not given a definitive date for General and Regional Elections,” the PPP stated.

In response, the President told reporters: “We will abide by what I said last night – elections will be held on 2nd of March. That is as definitive as I can get.

“What I said last night was quite accurate – that both the Commission and the Cabinet have considered the information that is available and elections will be held on the 2 March 2020.”

The President needs to make an official proclamation appointing March 2 as the date for elections.
He has not yet dissolved Parliament, which is the legal requirement for the holding of general elections.

Parliament has to be dissolved three months before general elections, meaning the President has up to December 2 to do so.

President David Granger on Thursday made it clear that general elections would be held on March 2, 2020, even if the opposition does not approve extending the life of the government.

“If the opposition doesn’t go to Parliament, then we will abide by what I said last night: elections will be held on the 2nd of March. That is as definitive as I can get,” he told reporters on the sidelines of an event.

The opposition People’s Progressive Party Civic (PPPC) Wednesday night reiterated that it would not go back to the National Assembly to extend the life of the government. The Alliance For Change, a governing coalition partner, has expressed worry that if the extension is not granted, the elections process could be opened up to a legal challenge.

On the other hand, experts say the principle of necessity will kick in if the PPP does not go to the National Assembly on October 10 to grant the extension. Some experts say if elections are not held within three months of the passage of a no-confidence motion, it is only the National Assembly that can set a new election date.

While President Granger is yet to dissolve Parliament and name an elections date, it is expected that he will do so after October 10.

Asked whether he would be meeting with Opposition Leader, Bharrat Jagdeo, the President remarked that Jagdeo speaks to the media. “If he wants to speak to me, he can speak to me,” Granger said.

Political Science Professor David Hinds says the upcoming elections campaign will be the longest in Guyana’s post-independence history, opening up the possibility of an exhaustion of ideas or a resort to unconventional tactics.

Political Science Professor, Baytoram Ramharack on Wednesday expressed concern about the failure of the President to definitively state the elections date in his five-minute address to the nation.

In recent days, international and local pressure has been mounting on the Granger administration to name an early election date and bring an end to unconstitutional rule with September 18, 2019 having passed.

The opposition Peoples Progressive Party (PPP) on Thursday afternoon appeared to accept the March 02 date announced by President David Granger for general elections, with the Opposition Leader Bharrat Jagdeo saying he is giving the President the benefit of the doubt.

“We are disappointed, but we have to work towards that date,” Jagdeo said at a press conference held at his Church Street, Georgetown office.

The PPP had expressed reservations about the date, given the choice of words used by the President. The President Wednesday night said“the earliest possible” date for elections is March 2.

The PPP determined that that was not a definitive date but President Granger Thursday morning clarified that March 02 is indeed the definitive date.

The Opposition Leader maintained that the PPP will not attend Parliament. The Government is seeking to hold a Parliamentary session to extend the elections date, since it falls way outside of the three months the Constitution requires upon the passage of a No-Confidence motion.

But Jagdeo said the PPP will not be “blackmailed” into attending Parliament, because in seeking Parliamentary approval for an extended elections date, the President is seeking to extend the life of his Government and therefore give legal cover for all that has happened since December 21 when the No Confidence motion was passed.

Following legal challenges to the No-Confidence Motion, the effective start date of the elections timetable began on June 18 with the final rulingof the Caribbean Court of Justice.

That meant elections should have been held by September 18. That date could only have been extended with a vote of 2/3 of the National Assembly.

On Thursday morning, President Granger said whether the PPP returns to Parliament, elections will be held on March 02.

The Opposition Leader said a return to Parliament is wholly unnecessary since the Government is in caretaker mode and its only authority should be to “do everything necessary” for elections.

He said the President has the authority to proclaim the elections date and dissolve Parliament and doesn’t need Parliamentary approval for that.

Jagdeo said the PPP will be moving aggressively into campaigning.

He is pleased that the Guyana Elections Commission (GECOM) will begin the Claims and Objections period on October 1. He said this is the “right” process for persons not yet registered to do so and to make any changes needed to their information, whether it be a change of name or address. The period also allows for the names of dead persons to be removed.

“I want to urge all Guyanese to utilize this process fully,” Jagdeo stated.

He said too that he was “extremely pleased” that GECOM has agreed to invite the international community to participate in the machinery of GECOM as well as to be observers, saying the GECOM Secretariat needed “impartial” and “watchful eyes.”

We have been dealing with this type of political problem over half a century now. I don't see why we have to be taken aback. A country with less than a million people living a vast piece of virgin land should be happy as those living in Australia and Canada. We are still uncivilized people when looked at from the perspective of a civilized western society.

Something here is not too clear to me.  Are you saying if there was no NCV there would not have been this crisis that we are experiencing? 

It’s difficult to say what if and what if not.  However, the NCV caused the PNC base to rally around the President.  They had grown disappointed in the ruling junta.  Maybe the divisions would not be as sharp and the base not as motivated. But it’s all second guessing!

I think though, the PNC would not want to relinquish power easily but not sure what they would have told their base.  Now they using the NCV to show Indians don’t accept them to rule.  While one side celebrates, the other sees treachery!

I believe Jagdeo made their job easier by his brash statement after the CCJ shot down his 3rd term attempt.  Then his selection of Irfaan left no doubt he intends to run the cake shop like Putin.  

The international community looks on with jaundice eyes and turning a blind eye to Granger’s infractions as long as there is no major violence and upheaval. 

I believe Granger now has a free rein and will play it cleverly.  He knows where he stands with the international community.  Ayuh coolies could keep buzeing till Ayuh geh hoarse!
