Former President Bharrat Jagdeo was yesterday barred from leaving Guyana without the court’s permission during his trial for a private criminal matter brought against him.

The order was handed down by Magistrate Charlyn Artiga when Jagdeo belatedly appeared before her at the Whim Magistrate’s Court in Berbice.

 

Jagdeo, who was a no show when the matter was first called a few weeks ago, turned up yesterday in time to avoid an arrest warrant being issued for him.

 

When the matter as called yesterday(Mon May 25th), the Former President was again absent and the matter was briefly adjourned to give him time.

 

It was called a second time and again Jagdeo was not there to answer to the charge.

 

One of his attorneys, Senior Counsel Bernard De Santos informed the Magistrate that Jagdeo was on his way.

 

The magistrate then informed the lawyer that she was giving the former head of state 30 minutes to show up or an arrest warrant would be issued.

Jagdeo eventually arrived at the court at 11:30 hours.

 

He was promptly placed in the prisoners dock as the indictable charge was read to him by Magistrate Artiga.

 

It is alleged that on March 8 at Babu Jaan, Berbice, Jagdeo made statements contrary to section 139 D (1)a of the representation of the people act chapter 103 as amended by act number one of 2001.

 

The charge was brought by prominent chartered accountant, Attorney-at-Law Christopher Ram.

 

Former Attorney General, Anil Nandlall, who is also a part of Jagdeo’s defence team made an application for bail, stating that the former president is well known and is not a flight risk.

 

The prosecution did not object to bail and Magistrate Artiga then sent Jagdeo on self bail, but with conditions.

 

Magistrate Artiga ordered that Jagdeo should not leave the jurisdiction without the permission of the court.

 

She ordered that should he have to attend to any emergency overseas, his lawyers must make contact with attorneys from the other side. (His lawyers will have to get permission from Christopher Ram before he even think of going close to Ogle or Timheri)

Jagdeo appears in court over private criminal charge

Former President Bharrat Jagdeo this morning appeared in the Whim Magistrate’s Court on a charge of making racially divisive statements in contravention of section 139D of The Representation of the People Act, Cap 1:02 and was sent off on his own recognisance and instructed to return to court on June 23 for the beginning of the preliminary inquiry into the matter.

 

Magistrate Charlyn Artiga also ordered that he not leave the jurisdiction without permission.

This is Jagdeo’s first appearance in court in this matter even though on April 20 his lawyers had argued for the dismissal of the charge that was brought against him by chartered accountant Christopher Ram.

 

Jagdeo was not in court when the matter was initially called this morning and the magistrate threatened to issue an arrest warrant for him.

 

After some deliberation he was given time to make an appearance which he eventually did.

 

He did not say anything in court, aside from giving his address as Sparendaam, as he was not required to plead to the charge.

 

Ram filed the private criminal charge over controversial statements Jagdeo had made at a remembrance ceremony for late president Cheddi Jagan at Babu John, Port Mourant on March 8.

Jagdeo was widely condemned for these statements in which he used a pejorative term to describe Indo-Guyanese and stated that this was how another section of the populace referred to them. 

 

He gained full support from the former ruling party for these statements.

 

The statements were later described as racially divisive by the Media Monitoring Unit of the Guyana Elections Commission.

 

When the matter was called on April 20 there was even more drama on the outside as a confrontation between rights activist Sherlina Nageer and Health Minister Dr Bheri Ramsaran gained wide publicity over abusive remarks made by Ramsaran.

 

A separate rant against Nageer by Ramsaran eventually resulted in him being dismissed by then President Donald Ramotar.

Former President Bharrat Jagdeo was Monday banned from leaving Guyana until the hearing and determination of an indictable charge of uttering racially divisive remarks.

Attorney-at-Law, Christopher Ram has filed a private criminal charge against Jagdeo, saying that he that he uttered racially divisive remarks in violation of one of Guyana’s electoral laws on March 8 at Babu John, Port Mourant, Corentyne.

Despite efforts by Jagdeo’s lawyers to have the charge scrapped, Whim Magistrate Charlyn Artiga read the charge to the former Guyanese leader while he stood in the dock.(Jagdeo in the Prisioners Dock)
 

He was not required to plea to the indictable charge.
 
Artiga told Jagdeo that he could not leave Guyana until the hearing and determination of the matter or with the permission of the court in case of an emergency.

Jagdeo was released on self-bail and told to return to court on June 22, 2015.

He is accused of making racially divisive remarks to the public at large in contravention of the Representation of the People Act.

If found guilty, he could be fined GUY$100,000 and jailed for two years.

The Representation of the People Act also says that a guilty person would be barred from being a member of the National Assembly, local democratic organ or the holder of any constitutional or statutory office.

I guess it is easy to rekindle. Who in today's age ask for a permit to protest? The silly law where a person at a political campaign can't politically assassinate their political opponent is ludicrous. Nonetheless, it is the law and passed while Jagdeo was president so I have no problem with him being charged with it.

– former president races to court after threat of Arrest Warrant Magistrate Charlyn Artiga, yesterday, barred former President Bharat Jagdeo from leaving Guyana without the permission of the court. The decision came during his appearance to answer a charge of a private jagdeo in courtcriminal matter brought against him. The order came when Jagdeo belatedly appeared before the Magistrate at the Whim Magistrate’s Court in Berbice. Jagdeo was a no show when the matter was first called a few weeks ago, but he turned up yesterday in time to avoid an arrest warrant being issued for him. Jagdeo was summoned to court on a private charge brought by lawyer Chris Ram. The charge stemmed from Jagdeo’s comments on Sunday March 8 at Babu Jaan, Port Mourant, Berbice. It is alleged that on March 8 at Babu Jaan, Berbice, Jagdeo made statements contrary to section 139 D (1) of the Representation of the People Act Chapter 103 as amended by Act number one of 2001. 139 D says (1) Any person who (a) makes or published or causes to be made or published, any statement; or (b) takes any action, which results or can result in racial or ethnic violence or hatred among the people shall be liable on conviction on indictment to a fine of one hundred thousand dollars together with imprisonment for two years. β€œThe opposition consistently shout about the racism of the PPP but they practise racism. The opposition beat drums at six in the morning and say let us throw out those coolie people,” Jagdeo had stated. Ram had argued that his statement β€œcan result in racial or ethnic violence or hatred among the people”. At the first hearing a few weeks ago, Jagdeo’s lawyers had argued that the charge was frivolous, vexatious and without any basis in law. They requested that it be dismissed by the learned Magistrate. Ram’s attorney requested time to respond. When the matter as called again yesterday, Jagdeo was again absent. Counsel for both sides were asked to address the court on the question of summons, after which it was adjourned for half an hour. When the matter resumed Attorney at Law, Perry Gossai, representing Jagdeo told the court that his client was stuck at the Berbice River Bridge. The matter was again adjourned to give Jagdeo time to make his way to the court. A few hours later two other lawyers on Jagdeo’s team, former Attorneys General Anil Nandlall and Bernard de Santos turned up to tell the court that the summons was never served on Jagdeo. The lawyers also told the Magistrate that they advised their client that as a result of not being served with the summons, his presence was not necessary. The Magistrate then overruled their submissions made and ordered that Jagdeo must appear before her. She then informed them that she was giving Jagdeo 30 minutes to show up failing which she would issue an arrest warrant for him. Jagdeo eventually arrived at the court at 11:30 hours having sped along the East Coast Demerara and West Berbice Highway. He was promptly placed in the prisoners dock to have the indictable charge read to him by Magistrate Artiga. Anil Nandlall made an application for bail, stating that the former President is well known and is not a flight risk. He reminded the court that Jagdeo was the β€œChampion of the Earth”; had four honorary doctorates (Jagdeo has five honorary doctorates) and was on the list of candidates for the People’s Progressive Party Civic for the recently held General and Regional elections. He also informed that the 52-year-old former president is single and has a fixed place of abode. There is no reason why he would not attend the court hearings in the matter, he said. The Prosecution had no objections to Jagdeo’s pre-trial liberty, so Magistrate Artiga then sent Jagdeo on self bail, but with conditions. Magistrate Artiga ordered that Jagdeo should not leave the jurisdiction without the permission of the court. She ordered that should he have to attend to any emergency overseas, his lawyers must make contact with Attorneys from the other side. The matter was then put down for June 22 for the commencement of the preliminary inquiry. A pitiful Jagdeo then made his way to the Magistrate’s clerk to sign the reconnaissance before leaving the courtroom to join his die hard supporters who had gathered outside with their placards, protesting the court action. If found guilty Jagdeo could be fined $100,000 and jailed for two years. Meanwhile, the People’s Progressive Party has criticized the Magistrate’s decision to prevent Jagdeo from leaving the Jurisdiction of Guyana unless permission is granted. The party stated it views the development as an β€œominous sign.” β€œWe view this as a violation of the Constitutional right and freedom of Cde. Jagdeo to travel, as well as a threat to the constitutional rights and freedoms of Guyanese everywhere,” the party stated. Jagdeo is not above the law, one lawyer said. He is not the first person to be restricted from travelling once before the court having faced indictable charges, the lawyer added. He is also a private citizen and he is being treated as such.

Dem boys wake up yesterday and heard de news how Soulja Bai decide to remove 60 prisonersβ€”petty thieves.

 

At first when dem boys hear it dem was li’l baffled. Dem never hear anything like that. It was during de course of de day dem hear that Soulja Bai was really mekking space fuh de real, real thief.

 

De fuss one appear in court yesterday. Dem see when he fly out he house like labba from a hole. De man was travelling suh fast that people nah recognise he.

De only way people know was he was de smell of sulphur he lef behind.

 

De Chat-3 did tell de man that he bigger than any court in de land, that he ain’t got to tun up. And he believe that and stay away.

 

Is when de magistrate give he 30 minutes to arrive in she court room or else she gun issue an arrest warrant fuh de man that he didn’t even bathe.

 

He pull on a Burnham shut-jac and drive heself to court. When he reach he come out wid a fake smile like everything alright, this time he belly rumbling and he touching, touching de back plug wha he get from farrin.

Then de magistrate ask he if he alright. He couldn’t talk, he poop again.

De smell confuse de Chat-3 brain suh that when he beg fuh bail he give wrang age, wrang qualification and even wrang name fuh de Shit-3. After de begging she put he pun self bail but warn him to keep away from airport. β€œDon’t even peep at you passport because you ain’t gun only poop when you come back.”

 

She advise him to go over to de clerk and sign he bail paper.  When dem boys watch he face, walking over to sign he look like a li’l *****cat wha get ketch wid he whole face in de milk pot.

 

Talk half and wait fuh de other 59 to appear before de courts.

Guilty. Fine 100,000 GYD and a suspended prison sentence as a first time offender. Maybe even coupled with a presidential pardon.
