Chief Justice, Roxane George-Wiltshire on Wednesday said the Caribbean Court of Justice (CCJ) indicated that elections must be held by September 18 or another date if Parliament grants an extension.

“The Honourable Chief Justice (ag) stated that the consequential orders of the Caribbean Court of Justice indicate that elections be held by September 18, 2019, or such longer period as the National Assembly determines,” according to a statement issued by the Supreme Court of Judicature.

Political commentator, Christopher Ram’s lawyer, Anil Nandlall, said Tuesday that the Chief Justice had said elections must be held by September 18, but he failed to mention that she had also said that there could also be a parliamentary extension.

The CCJ had declined to name a specific elections date, saying that was the constitutional preserve of the President, Opposition Leader, Parliament and to some extent the Guyana Elections Commission (GECOM). President David Granger and Opposition Leader Bharrat Jagdeo are yet to reach agreement on a new GECOM Chairman.

Jagdeo has repeatedly stated that his People’s Progressive Party (PPP) would not be lending support to the government for the required two-thirds parliamentary approval for an extension of the elections timeframe and the life of the caretaker administration.

The Chief Justice confirmed that she rejected Ram’s request for an order to stop the Guyana Elections Commission’s house-to-house registration exercise. Nandlall said the Chief Justice cited a lack of evidence by Ram to back his case that the exercise would result in a shift in the elections deadline.

Chief Elections Officer, Keith Lowenfield told the media on Tuesday that the existing voters’ list, which expired on April 30, could be refreshed and subjected to a claims and objections period for use to conduct a free and fair general and regional administrative council elections.

Lowenfield declined to comment on claims by President Granger and the governing coalition that the expired list is bloated by about 200,000 names and has other defects. The coalition has also argued that without house-too-house registration, thousands of youths would be unable to vote. But, the PPP said those who have not registered or have changed their residences could make amends through a claims and objections period.

The Chief Justice said the claim for an order compelling the Chief Elections Officer or the Commissioner of National Registration to take all necessary steps and actions to hold General and Regional Elections on or before September 18 has not been withdrawn.

Saying that another Fixed Date Application (FDA) has not been filed, she said Ram did not ask to resubmit the FDA. The applicant, however, requested and was given permission to file a supplementary affidavit in support of the FDA by 16:15hrs on July 23, to be served by 10:00 hrs on July 24, the Supreme Court added.

The hearing of the FDA stands adjourned to August 2nd.

The Chief Justice earlier this year had ruled that the December 21, 2018 no-confidence motion had been validly passed by 33 to 32 parliamentary votes and that the President and Cabinet had stood resigned and the President and government had remained in office to hold elections by March 21.

In a long-running legal battle, the Granger administration got a reprieve when the Guyana Court of Appeal struck down Justice George-Wiltshire’s decision on the single ground that the required absolute majority for passing a no-confidence motion was 34 instead of 33.

The CCJ earlier this month overturned the Guyana Court of Appeal’s decision, effectively saying that Chief Justice George-Wiltshire’s ruling was valid.

The Honourable Justice Roxane George Chief Justice (ag) has noted that there is some misinformation that has been carried in the news by different sections of the media with reference to the Fixed Date Application (FDA) filed by Christopher Ram vs. the Chief Elections Officer, Commissioner of the National Registration, The Guyana Elections Commission and the Attorney General which was heard on Tuesday, July 23, 2019.

The following clarifications are made:-

(1) The claim for an order compelling the Chief Elections Officer or the Commissioner of National Registration to take all necessary steps and actions to hold General and Regional Elections on or before the 18th day of September 2019 HAS NOT been withdrawn.

(2) Another FDA HAS NOT been filed. The Notice of Application filed with the FDA was dealt with by the court and only the conservatory order that was sought was refused.

(3) The applicant in the matter did not request to resubmit the FDA. The applicant, however, requested and was given permission to file a supplementary affidavit in support of the FDA by 16:15hrs on July 23, 2019, to be served by 10:00hrs on July 24, 2019.

(4) The Honourable Chief Justice (ag) stated that the consequential orders of the Caribbean Court of Justice indicate that elections be held by September 18, 2019, or such longer period as the National Assembly determines.

(5) The hearing of the FDA stands adjourned to August 2nd, 2019 and not August 7th, 2019.

About a week ago, Puerto Rico's Governor came under scrutiny for some comments he made. Because those comments were very egregious, protests emerged demanding that he resign. Last night he said that while he was democratically elected, he is resigning. Now seven months after the NCM, Granger, his PNC as well as the other Coalition parties have not been able to arise to the level of human decency to obey the laws of Guyana. Who would have thought that Granger would be more wicked than Rosello?

The extension of the Seotember 18, 2019 requires that 2/3 of the FULL Parliament agrees barring that, this Coalition begins squatting in office illegally after September 18, 2019.

Rule is the keyword. The PNC and AFC are too hapless to rule. They don't know how to govern. While the rest of the world's economies are rocketing to the moon, Guyana has been in a constant downward spiral since May 2015.

Granger is fully aware of this. When Oil initially entered the picture, he did all the necessary legal work and notified all relevant authorities.

The Coalition should still have enough decency to allow the voters to decide. It is not for Granger or Jagdeo to dictate what the citizens must accept.

Being competent may be above their pay grade but people can avoid being wicked and are totally at fault when they refuse to do the right things. That is my biggest issue with some people in the world. They want to sleep all day and still expect others to give them a handout. They want to steal other peoples’ properties and still complain when they get shot at. They want to live recklessly and refuse to take responsibility for their actions. And if everything else fails, they want to blame it on racism.

Democracy was never their thing.  Dr. Jagan, though a left-leaning politician he was always talking about the importance of democracy. The PPP never hijacked the ballot and governed illegally. Only one party has done that consistently throughout the post-colonial period and that party is the PNC.  We've never heard of rigged elections in pre-independent Guyana. This thing about rigging is a vile legacy of Linden Forbes Sampson Burnham. He subverted our democratic system and plundered the economy making Guyana one of the poorest in the Caribbean.  

Granger is out to secure political power in the same manner that Burnham did. I don't think he will get far.  The clock is ticking on his government.

The Western Diplomatic community is giving the gov't. time to do the right thing.  Just observe how the ambassadors are appealing to Granger to obey the constitution and the CCJ's decisions.  They will up the ante as time goes by. They are giving Granger rope for now.

Why? Going to elections does not guarantee a PPP victory.  Elections will be held one way or another. The APNU should stop dilly dallying. Get it out of the way. Let the people decide who they want.

The Western Diplomatic community is giving the gov't. time to do the right thing.  Just observe how the ambassadors are appealing to Granger to obey the constitution and the CCJ's decisions.  They will up the ante as time goes by. They are giving Granger rope for now. 

DG is superior to the constitution. Perhaps, the Western Diplomatic Community see that the election may not make a difference. I doubt whether the PPP can win even by a majority of 1.

Not really. The observers best able to render judgment (CCJ) offered the PNC no validity of their behavior. One is not supposed to lose every argument like the Coalition did at the CCJ. Granger isn’t out maneuvering anyone. He is just fortunate the PPP and it’s supporters aren’t inclined to burn the country down like the PNC supporters would do.

I agree. Although I doubt the PPP would burn any cane field maliciously. It must have been harvesting time and the fools must have mistaken that for the PPP maliciously burning cane fields. 

Now there is no mistaking the malicious behavior of the PNC and its supporters which began around 1962.

Correct views on elections timeline.

Extension beyond the September date can be granted with a positive vote of two-thirds or more of all elected members of the National Assembly.

Such process is explicitly stated in the constitution.

Guyana Constitution , Section 106, subsections (6) and (7)

(6) The Cabinet including the President shall resign if the Government is defeated by the vote of a majority of all the elected members of the National Assembly on a vote of confidence.

(7) Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly shall by resolution supported by not less than two-thirds of the votes of all the elected members of the National Assembly determine, and shall resign after the President takes the oath of office following the election.”

Ksazma, the Coalition has only 33 votes and it would be of interest to see how they can make 33 equal to 44 or 45.

Those two appellate court fools  will rule that those 33 votes equal 44 or 45 depending on which number that fool Williams prefer. 😀
