There are some who posted here on this forum that no elections petitions would be filed. We now know that two were filed and the CJ has indicated that there will be full blown trial in one of them, i.e., witnesses will be called and cross examined etc. The other one perhaps will be decided by legal arguments only. Rather than getting the truth before the Court quickly to clear the air Jagdeo and Ali are claiming a procedural irregularity as they were not served. What are they afraid of --the evidence that will be presented?

Honestly, Totaram, I pray the truth shall prevail and the people will accept the ruling. But even the judicial system is bought. I do think this will once again be decided by the CCJ. Mendes is quite crafty, similar to his clients.
Stop building high expectations, it's a slam dunk game over. Once again the PNC circus in town and the clowns will give colorful display.

CJ to hear preliminary issues on petitions on November 24

On November 24th acting Chief Justice Roxane George-Wiltshire will commence hearing arguments on preliminary issues raised in the two election petitions filed by the main Opposition A Partnership for National Unity+Alliance For Change (APNU+AFC) which is challenging the results of the March 2nd polls.
The announcement was made during a case management conference (CMC) this afternoon.
Douglas Mendes SC has raised the preliminary issue that because his clientsâPresident Irfaan Ali and Bharrat Jagdeo were not served on time in accordance with the prescribed Rules, the petitions may themselves amount to a nullity.
No date has yet been fixed for hearing of the substantive petitions.
It has also not yet been determined by the Court whether the two petitions will be heard together.

The problem with you and Rochelle is that you cant seem to get over the fact that the coalition lost this election fair and square. They attempt to rig the outcome while the world was watching. Now the key riggers are in court. That is going to further hurt the coalition and their case.
No court is going to find that this election was fraudulent and that the coalition won. It would be asinine and it would put the judgment of that judge in question. Even if this case was to reach the CCJ, the members of the CCJ will not be disposed to buy into any convincing argument that this election was fraudulent. They were already treated to a litany of nonsense from the coalition....like what is the majority of 65...
When it comes to legal luminaries, the coalition has shown that they are not capable of arguing with a winning strategy.
Even if the case was tried and the coalition were to pull off a win, elections will not be held in a short period of time. People still remember the 5 months of torture and the PPP has done a good job so far in the short time they have been in office. You seem to have decided the cases all the way to the ccj without a judge even looking at the evidence. I am conversant enough with the law to know that evidence matters.

Weren't you the one who stated ad nauseum that the PPP will never be the government of Guyana, never again? Well they have been since August 2, 2020. You do realize that the CCJ thinks the Coalition and its lawyers are a bunch of jokers. You think they will rule any different from how they did in July. Forde is asking for the Recount Order to be tossed out. Sadly for him the CCJ already ruled that the order is valid. He is also stating that he will not be presenting any witnesses but sadly for him the CJ has told him that witnesses are expected so they can be cross examined. He is also asking for Granger to be reinstated as President based on Mingo's SOPs. So far Mingo's SOPs have be hidden away but sadly for Forde and Mingo the CJ said parties and summon any evidence they wish so Mingo's mutilated SOPs will make an appearance now even though the other High Court Judge denied it when the PPP asked for it in May. For the other petition Robertson was not prepared to provide the list of his witnesses even though his petition was filed over a month ago.
In a nutshell, all the Coalition and its lawyers will provide is another dog and pony show. Meanwhile the PPP/C government will continue to govern Guyana and bring relief and prosperity to the people of Guyana. More of Guyana's oil is being sold bringing in lots of cold hard cash to the government coffers.
And yes, the PPP/C is the government of Guyana. Since August 2, 2020.

However, this is expected after she hears arguments on preliminary issues raised in the matter on November 24, 2020.

During the Case Management Conference (CMC) held in relation to the matters at the Georgetown High Court yesterday, the Chief Justice (CJ) told attorneys involved in the case via Zoom that the Court will hear âa full blown trial of the petitions,â filed to challenge the March 2, 2020 elections.
The judge however, did not give a date for the hearing of the substantive matter.
She instead noted that the Court will hear preliminary matters relating to the case after Douglas Mendes, SC of Trinidad who is leading the legal team for the Peopleâs Progressive Party Civic(PPP/C) raised an issue of his clientsâPresident Irfaan Ali and Bharrat Jagdeo not being served on time in accordance with the prescribed Court rules. As a result of this purported breach, the Lawyer held that the Court should proclaim the petitions as null and void.
As such, the CJ directed that the lawyers have the submissions for that application filed and served by November 20, 2020 while applications for elections documents must be filed on or before December 4, 2020. She noted that the Court will also meet again on November, 24, 26, and 30 to hear brief oral submissions in relation to an application to by Mendes on the issue of late service. On that point, the CJ noted that the former President David Granger was also served late. He was served on September 25 when he should have received the document five business days after the petition was filed on September 15.
Attorney Roysdale Forde SC
In addition to not scheduling a date for hearing the substantive case of the election petitions, the CJ determined the two petitions will be heard together. This determination was made in response to a request by attorney in the second petition filed to challenge the outcome of the March 02, 2020 elections, Mayo Robertson.
Robertson had asked that the petitions be heard separately since the matters dealt with distinct issues as the regards the conduct of the elections. The lawyer explained that the 2nd elections petition focuses on the allegations of irregularities and misconduct leveled at the Guyana Elections Commission, (GECOM) whereas the 1st election petition filed on behalf of the opposition seeks to the challenge the outcome of the polls based the issues as it relates to validity of Order 60 of 2020 under which the recount was held and the validity of Section 22 of the Election Law lections Law Amendment Act (ELAA) which that order was created.
âThere are the matters of widespread voter impersonation, widespread issues with documentation and a flawed voters list among other thingsâĶ
We are saying that as a result, the elections were not held in accordance with the constitutional requirement by GECOM which required by law to host free fair and credible elections. And we are going to ask that Court set aside the results of the elections and vitiates the entire process,â the lawyer explainingâĶ adding that he expects to call several witness to substantiate the claims of the affidavit supplied to the Court.
Attorney Mayo Robertson
Robertson noted however could not give a precise number of the witnesses he is expected to call. âI cannot give an exact number for fear of being bound by that figureâĶ In addition, there is still some fine tuning to be done as it regards which witnesses will testify about what,â Robertson attempted to explained.
The Chief Justice did not hide her disapproval at over Robertsonâs lack of preparedness.
âWell,â she said âI am surprised by that, Mr. Robertson because having filed the petition on the 15th of September and its very voluminous content, one would expect that you would at least know how many witnesses you would be calling to the trial.â
Further, Justice George- Wiltshire also told the attorney that her decision to hear the matters together is based on the fact that the issues laid out in the petitions are almost identical.
âTaking a different route but wanting the same result does not make the matters much different,â she stated.
At the interim, the CJ granted application for Attorney General Anil Nandlall to formally join both petitions, given his role under the constitution as the intervener of the State.
Nandlall will be joined by Attorney Prithima Kissoon, Chevy Devonish and Raeanna Clarke in the matter. Other lawyers engaged in the case include former Attorney General Basil Williams S.C who appeared on behalf of former President David Granger and the APNU+AFC Coalition; GECOM Commissioner Sase Gunraj who told the Court that the Commission has not retained Counsel but said it intends to defend itself during the proceedings; and Lawyers â Devindra Kissoon and Sanjeev Datadin, led by Senior Counsel Mendes appeared on behalf of Bharrat Jagdeo as representative for PPP/C.
Meanwhile, the Attorneys appearing on behalf of the defendant on the first petition are Trinidad Senior Counsel John Jeremie, Senior Counsel Roysdale Forde, Raphael Trotman and Olayne Joseph. Senior Counsel Rex McKay, Darren Wade, Mayo Roberson, Khemraj Ramjattan, Gary Best and Geeta Chandan-Edmond are appearing for the defendant in the second petition.

All through the cases around the elections judges kept informing Coalition lawyers that their cases should be brought through petitions. Now they are trying to make Sanjeev Datadin a special prosecutor in the criminal case against Lowenfield et al. The PPP is instinctively undemocratic. They are setting up a dangerous situation that would lead to unrest.

They are obsessed with Jagdeo. He causes them sleepless nights and miserable days.
Keep in mind Jagdeo was the first PPP leader to break the PNC's backs so it is not easy for them to get over that humility. When Jagdeo stood up in Parliament and looked across the aisle and pronounced "I am not afraid of any of you" it drove fear into their hearts and 3 short years later he orchestrated the successful NCM that they told him to "bring it on" even though their incompetence stood in the way of them even knowing what was being brought on. Now they are surviving on sour grapes.

Mendes is making a mint from Jagdeo/Ali. This would be all well and good if there weren't rules on the financing of political parties that begs the question as to where the money to pay Mendes is coming from.
