President David Granger, this morning, told reporters that he has never acted outside of the Constitution and maintains that his unilateral appointment of retired Justice James Patterson to the post of Chairman of the Guyana Elections Commission (GECOM) is not flawed.

The process adopted by the president to appoint the Chairman of GECOM is FLAWED.

The president can ONLY unilaterally appoint the Chairman of GECOM when the Leader of the Opposition FAILED to submit a list of candidates for consideration for the position.

Succinctly, the process is ....

1. Leader of the Opposition submits to the president a list of candidates.

2. President selects a candidate or rejects the entire list.

3. Matter is returned to the Leader of the Opposition to re-submit a list.

4. Process continues until a candidate is selected from a list.

NOTE:

a. The ONLY instance when the president can UNILATERALLY appoint a Chairman is when the Leader of the Opposition FAILS to submit a list of candidates.

b. Leader of the Opposition SUBMITTED a list of candidates at all times.

Guyana Constitution

Guyana Constitution clearly outlined to process for the appointment of a Chairman of GECOM from a submitted list or for the appointment when the Leader of the Opposition FAILS to submit a list of candidates.

Oh meh mumma, the benevolent jackass Granger know more about law than de judges on the CCJ. 

Looks like Granger wasn't duly briefed on the comments that the CCJ made publicly yesterday. They actually laid out where his actions were unconstitutional and flawed.
