We can argue on the point that guns don't kill. In a court of law in the United States, anything can be used as a weapon, depending on your intention of using them. If you hit a person with a squash and caused injury to that person, the squash becomes a weapon. This is a very delicate argument between people and weapons and who/what is to blame.

Anyone who is trained to kill in combat, kill a non skilled civilian can be charged for murder for using his technique as a weapon. This has proven many times in the United States.

While a gun by its sole existence do not commit a crime, it is the individuals who use them commit the actions.
