Guyana gov’t will “honour and obey” CCJ judgments on no-confidence motion, GECOM Chairman appointment

Director-General of the Ministry of the Presidency, Joseph Harmon said Friday that the Guyana government would abide by next week Tuesday’s judgments on whether last December’s no-confidence motion is valid and if President David Granger’s unilateral appointment of James Patterson as Chairman of the Guyana Elections Commission (GECOM) is unconstitutional.

“Whatever decision the court arrives at, it is a decision, which we as a government we have committed to accept it and, therefore, we have no trepidation or fear about the decision itself. We are prepared for whatever the court will decide. We will accept the finding of the court and we  will act on that finding,” Harmon said.

Legal experts say if the CCJ finds that the motion was validly passed, the court may also issue consequential orders concerning the time-frame within which general elections should be held.

The Director-General said “we feel bound” by the CCJ’s decision, and “we will honour and obey the decision of the court”.

The Guyana Court of Appeal, which had ruled that the motion needed an absolute majority of 34 of the 65 parliamentary votes to be validly passed, has also pointed out that if that had been the case, elections would have had to be held within three months. The motion secured 33 votes after then government parliamentarian, Charrandass Persaud, had voted for the opposition-sponsored motion that the PPP had hoped would have triggered elections by March, 2019.

Opposition Leader, Bharrat Jagdeo, through his lawyer Douglas Mendes, has already indicated that he would ask the CCJ to consider allowing general elections to be held under the GECOM chairmanship of Patterson even if the court finds that his appointment was unconstitutional.

If Jagdeo does not get his way, analysts believe that the appointment of a new GECOM Chairman by the President can take several months.

Patterson and the three pro-government elections commissioners have already agreed to conduct house-to-house registration to extract a fresh voters’ list in time for elections to be possibly held in November, 2019.

The National Assembly has already approved GYD$134 million for GECOM to conduct the polls.

The High Court is yet to decide on the constitutionality of house-to-house registration on the grounds by a United Kingdom-based retiree that she would be disenfranchised because her name would be taken off the existing voters’ list.

A legal opinion by GECOM’s Legal Adviser, Attorney-at-Law Excellence Dazzell that the voters’ list, which expired on April 30, needs to be extended, has been rebuffed by the pro-government elections commissioners.

President Granger in 2017 rejected the Opposition Leader’s 18 nominees for the post of GECOM Chairman and after almost one year and the setting of a number of conditions, appointed Patterson to succeed Dr. Steve Surujbally who resigned after several years at the helm of the seven-member commission.

Among the nominees had been former GECOM Chairman, Retired Major-General Joseph Singh.

Perhaps, they have now realized that they have to abide by the ruling.

Yes. He stated that at the meeting in Queens.  If the ruling is against, then election in 2020 as usual.  Not that longer anyway.  The NCV thingy did not pan out as planned!

If CCJ rules against the PPP will we see screams at Freedom House "we hate dem blackman because dem blackman tief!"  Will you and Prashad scream about a plot by blacks in the English speaking Caribbean to drive Indians out.

Any way regardless of the ruling elections aren't likely to be held too soon. So it doesn't like as if Jagdeo got his wish of a shock election.

Well, the PPP still doesn't agree with the 2015 elections results but all they have done about it is some very boring placard protests. When the PNC disagreed in the past, they resorted to violence and rioting. So the PPP owes no one any apologies.

GNI cracks me up.  I met up with some Guyanese relatives last week, we over here are more concerned than them.  In fact I understand few are leaning Coalition. Their only concern is peace and that the oil flows start soon.  Beyond that, PPP or PNC, neither here nor there.

They rioted in 1997 and maybe 2001.  The riots began to have adverse impact on their base and were instrumental in having Trotman leave the PNC.

Hammie Green who rioted in 1992 became one of Janet's best friends and many of the thugs involved are now within the bosom of the PPP. You know people like Joe Hamilton, and the rest. Some even are PPP MPs!

No riots in 2006 nor in 2011.   You can scream as you wish and lie as you want but most black people were against the riots.

PPP violence involves paying ex Hammie Green thugs to beat up people, and tap people's phones and victimize them. This using a FARC connected criminal, wanted by the USA, to mastermind the thuggery.  Under that Jagdeo/RK criminal enterprise was fast turning GT into 1990s Medellin.

Then Jagdeo pulled the Irfaan stunt, that has the nation laughing, and suddenly things didn't seem so grim.

Exxon will decide the winner.  The PPP's problem is that they might think that Jagdeo is more expensive to keep than Harmon.

I tell people, Exxon will decide the outcome!  Clearly the prefer the Coalition!!

Exactly. They rioted. PPP didn't. Therefore the PNC supporters have the record for rioting and violence while the PPP supporters don't. Conclusion, the PPP supporters owe no one any apologies.

And they were getting ready to become violent in 2015 that even you admit that Granger had to tell them to behave themselves.

And don't forget, that dummy Williams pretty much told the CCJ judges that if they don't rule in the Coalition's favor, there would be problems in Guyana. So he too knows that the PNC supporters will behave violently.

Of course. How can they not like that 2016 PSA? It reminded them of how capital was acquired way back in the days. Even human capital.
