On the 3rd December 2021, the Guyana Police Force issued a ๐–๐š๐ง๐ญ๐ž๐ ๐๐ฎ๐ฅ๐ฅ๐ž๐ญ๐ข๐ง for Rickford Burke in relation to the following offences:
โ€ข The excitement of hostility or ill-will on the grounds of Race, under the Racial Hostility Act.
โ€ข Sedition under the Cyber Crime Act.
โ€ข Use of a computer system to coerce and intimidate a person, under the Cyber Crime Act.
โ€ข Seditious Libel contrary to common law.
โ€ข Seditious Libel under the peace under the Summary Jurisdiction Offences Act
โ€ข Inciting public terror under the Criminal Law Offences Act
Subsequently, on the 29th day of September 2022, the Guyana Police Force again issued a Wanted Bulletin for Rickford Burke in relation to the offence of Conspiracy to Commit a Felony, Contrary to Section 33 of the Criminal Law (Offences) Act, Chapter 8:01 with regards to the publication of defamatory libel in order to extort money from Afras Mohammed.
Subsequently, on the 18th day of August, 2023, two charges were filed at the Vigilance Magistrateโ€™s Court against Rickford Burke for the said offence. However, Rickford Burke who resides in the United States of America, was absent from Court.
As such, the Magistrate ordered that the 'defendant summons' be prepared and served on Rickford Burke to attend the Vigilance Magistrateโ€™s court on the 28th day of March 2024. As such, pursuant to the order of the Court, two (2) defendant summons were subsequently prepared and on the 13th day of December, 2023, an Officer of the Guyana Police Force, ASP Rodwell Sarabo left Guyana and travelled to the United States of America with both defendant summons in his possession.
On the 16th December 2023, ASP Rodwell Sarabo met with Mark Wesserman, a Process Server based in the United States of America and they served both defendant summons on Rickford Burke at his home address at Maple Street, Brooklyn, New York. Both defendant summons were read to Rickford Burke and he said he understood.
Finally, the Guyana Police Force wishes to make it known that a similar course of action will be adopted against persons who are outside of the jurisdiction and engage in criminal conduct.

Elements of the Guyana police force is obviously operating maliciously, limiting free expression of one's heart emotions--not a humanitarian crime to express racism. Evil is trying to protect itself (God) by limiting free expression. All words are required in life to solve the problems of life known and unknown. As a schizophrenic and to all schizophrenics, we have to reason to uncover what is causing mental illness and that requires the use of psychotic modalities. Don't judge us with the normalcy of law, especially the targeting of the uneducated and children being targets of law that seem to be moral with implied intentions to suppress freedom of expression. The guilty evade the law because they are smart---being smart can be a crime with intent to deceive MAN.

Government to go after โ€œsocial media influencersโ€ for irresponsible comments against Government -Jagdeo

The Government of Guyana has signaled its intention to go after โ€œsocial media influencersโ€ for what it considers to be irresponsible comments against Government officials and private individuals on social media.

At a Freedom House press conference today, Vice President Bharrat Jagdeo, said persons who make comments on social media will be held responsible for those comments.

He said private citizens should also take action against those โ€œinfluencersโ€ who use the social media platforms to attack them.

โ€œSo, I hope that the social media influencers who are operating under the guise that they are not in our jurisdiction and they feel safe abroad, safe from the reach of our law, that they are taking note too and I hope that anyone that the malign, sue them now and hire somebody abroad to serve them notice or the summon and make sure they video it like they did Rickford Burke and then proceed in Court,โ€ Jagdeo urged.

The Guyana Police Force recently dispatched one of its officers to the United States to serve a Court summons on political activist Rickford Burke, who has been openly critical of the Guyana Government. Burke, who has been living in the US for more than 25 years, has dismissed the charges against him.

Burke has said he was never served with the summons and indicated that the Guyana Police Force has no jurisdiction in the United States to serve him with any Court document.

Mr. Jagdeo said it cannot be business as usual when persons think they can say whatever about the government or citizens and have a free pass. He said persons ought to be held responsible for their utterances on social media.

โ€œThey live abroad, they have nothing good to say about country, they sow divisions, discord every single day by their comments. They use social media as a weapon against the government and also private citizens and as a means of extorting people, and clearly this cant be free speech, this canโ€™t be protected speech, this is criminality,โ€ Jagdeo said.

He said if persons in Guyana, say some of the things, those overseas Guyanese are saying, they have to face the law, and similarly, those overseas will also have to face the law.

โ€œSo, I am so pleased that we could actually start holding people accountable for what they say. People can say whatever they wish. But if its seditious, you have to face the court,โ€ Mr. Jagdeo pointed out.

Since taking office, the Government has filed a number of cyber crime cases against various persons for statements on social media.

A magistrate acting within the provisions of the Summary Jurisdiction (Magistrates) Act Cap 3:05 does not have the authority to issue a summons to be served on someone outside of Guyana

Happy New Year.  I read a letter in the Sunday Chronicle December 31, 2023 by Mr. Robin Singh appearing under the headline, โ€œFor too long persons abroad have acted as though they are beyond our lawsโ€.

He quoted a Canadian case, Pietersv Guyana National Newspapers Limited 2020 Cam Can LI 107882 (ON SC) and stated that he โ€œwould hasten to advise our local judiciary to adopt the precedent soonest.โ€ This case was from the Ontario Superior Court of Justice.  It is a persuasive authority but not a binding precedent.

In the High Court case 2020-HC-DEM-CIV-FDA-568 between Msenga Jones v Gecom et al, an application for judicial review Madam Chief Justice (Ag) Roxane George stated inter alia that โ€œApart from res judicata under the common law system, applying the principle of stare decisis, I am bound to follow the decisions of the CA and ultimately the apex court, the CCJ.โ€

Mr. Singh also stated that โ€œAs local lawyers Roysdale Forde and Darren Wade continue to defy logic and common sense in asserting that the โ€˜serviceโ€™ of Guyanese court summons cannot be effected in the United States.โ€

A Magistrate is a creature of statute and that is such a fundamental principle of law that one can always not think there would be any ignorance, much fewer questions about it.  Unfortunately, that is not so.

A Magistrateโ€™s powers and duties emanate and are limited to the provisions of the Summary Jurisdiction (Magistrates) Act Cap 3:05.

Section 68 (1) of the Summary Jurisdiction (Magistrates) Act Cap 3:05 states:

โ€œAll summonses, warrants, orders, judgments, writs of execution or other process or proceedings, whether civil or criminal, issued or taken by or by the authority of any magistrate respecting any matter within his jurisdiction shall have full force and effect and may be served or executed anywhere within Guyana (emphasis mine) by a bailiff of the court by the police or other constable to whom they are directed, or by any other police or other constable, as the case may be.โ€

There is no ambiguity in this section and a Magistrate acting within the provisions of the Summary Jurisdiction (Magistrates) Act Cap 3:05 does not have the authority to issue a summons to be served on someone outside of Guyana.
