INDIAN AMERICAN DOCTORS WIN RACIAL DISCRIMINATION CASE IN THE USA 

Three Indian American doctors, who were derogatorily called "the Indians" and treated as "second-class citizens" by the CEO of a medical center in the US, have won a racial discrimination case in a Texas court.

 

The US Fifth Circuit Court of Appeals found that Citizens Medical Center in Victoria had violated the equal protection rights of the doctors. The court ruled in favor of Ajay Gaalla, Harish Chandna and Dakshesh Parikh.

 

In February 2010, the medical center filed a resolution that would allow only cardiologists with contracts at the hospital to exercise clinical privileges in the cardiology department or part of the hospital's heart program.

 

The cardiologists fought back with a lawsuit stating they were being barred from practicing not based on their merit and expertise, but because of economical and racial reasons. This not only affected them, but their patients who were denied the right to see the physician of their choice, according to the court documents.

 

The hospital claimed the resolution was based on the doctors' disruptive behavior and issues with Dr Yusuke Yahagi, a cardiovascular surgeon at the hospital. Court documents also showed that the three cardiologists were derogatorily referred to as "the Indians."

 

The cardiologists also cited a comment from David Brown, the hospital chief executive officer, as saying the hospital was working on a plan for "getting the Indians off the reservation." The cardiologists said the resolution hospital placed violated their equal protection rights - and now the Fifth Circuit has voted in their favor.

 

The three doctors said they were consistently treated like second-class citizens, removed from committees and pushed out of laboratory posts arbitrarily, or overlooked in favor of "less-qualified" cardiologists CMC hired.

 

For now, the case is in stay, or on hold, according to Monte James, the lead attorney for the cardiologists. He expects the federal court will take it off hold, and it will proceed to trial.

Didn't everyone get the memo? Its ok to be racist against Indians . Imagine if the CEO had treated African Americans in this manner ?  The CEO would immediately be fired , hospital would be publicly shamed , financially penalized to the tune of millions and hire more Blacks. I wonder if an American in India would've been given the same opportunities.

 

Indians must realise that their primitive country will never be able to reciprocate the justice Indian individuals get abroad. That's the first reason why they escape their home country. So, the rednecks of America are still fairer and more civilised than the most cultivated people of India.

Well Redux , On the one hand , you have plans in place to get rid of Indians in Medicine not only by this hospital in question but by the AMA which has kept residency spots stagnant while increasing us medical school spots , with the unapologetic aim of keeping out International Medical Graduates . Its not so much about about blacks but the systemic unfair practices which seek to promote Minorities such as blacks and latinos while suppressing higher scoring asians . This is specifically seen in affirmative action programs and even in Obama's healthcare reform which specifically awards millions to institutions who specifically hire black and latino doctors .

The criticque of affirmative action is indeed relevant as this thread is about racial injustice and in the opinion of many professionals , affirmative action is racial injustice . The double standard is worth highliting . One of the major opponents of affirmative action is Ward Connerly , a black man ..who has sponsored legislation against affirmative action .

 

BTW.."taxpayer's money "at work is causing a severe lack of access to doctors by preventing International medical graduates  access to residency training .

The topic of this thread is racial injustice and pointing out the ironies and double standards is relevant to the discussion . Ward Connerly is relevant because you seem to project some racist tangent to this discussion . A black man against affirmative action ..does that shock you ?  Does he have an" ethnic ghetto " mind too ?

 

And contrary to your stated opinion , I have firsthand experience and knowledge on this issue . There is an impending health crisis because of the critical shortage of doctors and foreign medical graduates are crucial to the solution . Thankfully , there is currently a bill being proposed to increase the residency spots .

 

BTW..if you really must know , the IMGs that we are talking about are usually the cream of the crop , the majority having already completed medical residency in their home countries with research experience and scoring above the 99thpercentile in all three medical licensing exams .

NewsFlash, there are many, many prominent African Americans who are quite articulate in their opposition to affirmative action . . . this is an ongoing national debate.

You know of Ward Connerly only because he is loud, opportunistic and stupid!

Anyway, this has nothing to do with the problems of foreign Medical Graduates . . . just as the initiatives of the 1960's that paved the way for easy immigration of many, many medical graduates from India to the USA had nothing to do with racism towards Blacks and the civil rights debates vexing the country then!

We can have a civil conversation about facilitating [more] foreign medical professionals . . . but that is overwhelmingly an immigration [public policy] problem . . . not one of race relations.

I don't understand your linear thinking Redux .  Race and FMG professionals are intricately intertwined notwithstanding the side stepping of highly qualified US CITIZENS of asian ancestry , there is obvious racial discrimination . I pride myself on being a fair person who believes in equality but not equal outcomes . 

The compromise of integrity is the insidious bane that AA brings to all who thoughtless accept it. The mental acrobatics required to justify it leads to an internal twisting of the moral/professional compass. And will always remain the fuel for contempt of otherwise accomplished and worthy professionals. It should be abolished forthwith. And anyone who uses it is a coward.

BTW...Ward Connerly is mentioned because he has successfult implemented several propositions .

Those three Doctors are lucky that they are not in Canada or Britain.  They would have been called Pakis or Brown Paki.

 

In Canada they most likely would have joined the thousands of taxi Cab South Asian drivers/ doctors who cannot practice medicine because of Canadian smart racism against East Indian/Amerindian peoples.   Indians have much better opportunities in the United States than in Canada and Britain.  So enjoy it folks while it lasts.

Point well taken. Indians are progressive and will always make progress despite racism. We have Dr. Sanjay Gupta and many other respected Americans of Indian origin who will always make us proud.

Not that I'm in agreement with the practice in Canada but this is not only done to Indians. In Canada they do not accept papers from most countries.

A buddy of mine from Estonia is whiter than my screen but yet he cannot practice as a veterinarian, he needs to upgrade his papers to Canadian standards, so he now works as a superintendent for a condominium building.

The above is true about Canada. Canada is one hundred years behind on this issue and it is quite a disgrace.
