The Guyana Police Force (GPF) yesterday said that Deputy Chief Election Officer (DCEO) Roxanne Myers is being investigated for the offence of “conspiracy to defraud” after she surrendered to the police in the company of her lawyers on Tuesday.

Crime Chief Wendell Blanhum last evening told Stabroek News that Myers remained in police custody as the investigation into the alleged attempt to manipulate the results of the March 2nd elections continues.

In a statement issued yesterday morning, Police spokesman Assistant Commissioner Royston Andries-Junor said that Myers was arrested on Tuesday after she turned herself into the Criminal Investigation Department (CID) Headquarters, accompanied by her attorneys who included Nigel Hughes.

According to the police, Myers’ arrest came more than one month after several efforts made by investigators to locate her proved futile. “This was following a period of time of over a month, during which several efforts were made by the Police to contact Ms. Myers even at her place of work in relation to the post-March 2, 2020 elections incidents,” the police said.

The police added that a wanted bulletin was prepared to be issued by the GPF for Myers, but before it was sent out she surrendered

After being arrested, the police said Myers was told of the offence and she exercised her right to remain silent. “Further, Ms. Myers was promptly arrested for the offence of  `conspiracy to defraud’ and she was told of the allegation at the said time. She then exercised her right to remain silent,” the statement added.

Hughes had previously told Stabroek News that during a video interview with investigators at the CID headquarters on Tuesday, Myers exercised her right to silence.  He noted that it was after this development that she was informed that she would be arrested for alleged obstruction of justice.

He had said that despite the police having all the necessary information to institute charges for obstruction of justice there was no indication of such action and his client was refused bail when requested.

According to Hughes, his client was not aware that the police were searching for her. He said after seeing a news item in Tuesday’s edition of the Stabroek News, she contacted her lawyers and they subsequently made contact with the police.

The police yesterday however disputed this and said that contrary to statements attributed to  Hughes,  Myers was not arrested and detained because she exercised her right to remain silent.  The police said  Myers was  arrested for the offence of “conspiracy to defraud” and she was told of the allegation at the said time. She then exercised her right to remain silent.

In another statement yesterday afternoon, Hughes maintained his stance previously taken in relation to the matter.

Station diary

He invited the police to release the contents of the station diary at the CID HQ, which he said bore records that Myers was arrested at 12.30hrs on Tuesday for the offence of “perverting the court of justice”.

More than a month ago, the police announced that they had launched an investigation into the March elections and the events that occurred during the ensuing five months up to when President Irfaan Ali was declared the winner on August 2nd.

Since then, a number of individuals including APNU+AFC agent Volda Lawrence and several GECOM officials have faced charges stemming from their alleged involvement in the manipulation of the elections results.

Among the most recent to be arrested as part of the investigation were Chief Election Officer (CEO) Keith Lowenfield and APNU+AFC official Carol Joseph.

Lowenfield was taken into custody two Saturdays ago while Joseph was detained days after. They were both subsequently placed on station bail and are required to report to the police on specific dates as the investigation continues.

In a press release, police spokesperson Assistant Commissioner Royston Andries-Junor confirmed that Lowenfield had been arrested and taken to the CID Headquarters, at Eve Leary.

While there, Andries-Junor said, several allegations were levelled against Lowenfield in the presence of his attorney. Throughout the process, he remained silent.  “After being told of the allegations, Mr. Lowenfield exercised his right to remain silent,” the statement said. “There-after, a confrontation was held between him and a witness and once again Mr. Lowenfield opted to remain silent,” it added.

Upon completion of the process, the police said Lowenfield was released on station bail on the condition that he reports to the CID headquarters as ordered.

Lowenfield is already facing fraud and misconduct charges which were filed by private citizens Desmond Morian and Daniel Josh Kanhai over the handling of the results from the March 2nd polls. The DPP’s Chambers has since taken over prosecution.

District Four Returning Officer Clairmont Mingo was one of the first individuals who was arrested as part of the ongoing investigation and he has since been faced with multiple charges, for which he is out on bail.

Sheffern February, a clerk employed with GECOM, was also granted bail after she was charged with two counts of attempting to defraud the people of Guyana.

Those charges stated that while in the position of a clerk, she read incorrect numbers from the statements of poll. The charges are identical but pertain to the regional and general elections.

Enrique Livan, a GECOM Information Technology officer, was also brought before the court on a charge of manipulating the numbers of the statements of poll that were recorded in the system so that they reflected fraudulent numbers for District Four. He, too, was granted bail.

Crime Chief Wendell Blanhum had previously told Stabroek News that investigators are working towards wrapping up the probe this week.

Once this is completed, he said, the file will be sent to the Chambers of the Director of Public Prosecutions for legal advice on criminal charges to be instituted against those individuals who may be held criminally liable for their actions.

The Attorney representing the interest of the Deputy Chief Elections Officer (DCEO), Roxanne Myers is refuting claims made by the Guyana Police Force (GPF) as to its reason for detaining the elections official.

The police said this morning that the detainment of the DCEO was not because she chose to remain silent, but because she was a suspect in a “conspiracy to defraud” matter relating to the concluded March 2 General and Regional Elections.

Myers’ lawyer, however, said that such a charge was never put to his client.

I have read what purports to be a press release from the Guyana Police Force dated October 7, 2020 and which release is titled, “Police Statement Regarding Arrest of Deputy Chief Elections Officer, Ms. Roxanne Myers.”

Might I state categorically that the narration of the police of the events subsequent to Ms. Myers voluntarily attending the Criminal Investigation Department (CID), Eve Leary, is a radical, deliberate, and unfortunate departure from the truth. I remained at CID with Ms. Myers after Mr. Hughes was required to return to the Criminal Assizes. I sat through the police interview with Ms. Myers and remained at the CID up until Ms. Myers was being put into the police van to be taken to the Beterverwagting Police Station.

The interview was captured on video and my narration of the events, as they actually unfolded, can be corroborated by the video recording, pre-supposing that the integrity of the video recording is preserved.

The interview was conducted by Assistant Superintendent of Police (ASP), Mr. Caesar, Head of Major Crimes Unit, who introduced himself in these terms. He introduced Inspector Nigel Stephens as his scribe and Corporal Desmond Johnny as the operator of the video equipment. The interview commenced at 12:07 p.m. This time was relayed to me by ASP Caesar.

I inquired from ASP Caesar at the outset whether Ms. Myers was being treated as a suspect in the commission of any offence. He explicitly responded that she was not a suspect. Mr. Caesar then asked Ms. Myers if she would mind removing her mask briefly to permit the camera to capture her face. He made it clear that this was not compulsory. Ms. Myers politely declined observing that she is sensitive to the Covid-19 risk and wanted to avert any risk.

What follows is a substantively verbatim record of the questions ASP Caesar asked Ms. Myers and her responses:

1. Mr. Caesar: Ms. Myers, are you employed by GECOM?

Ms. Myers: I reserve my right to remain silent.

2. Mr. Caesar: Ms. Myers, are you Deputy CEO of GECOM?

Ms. Myers: I reserve my right to remain silent.

3. Mr. Caesar: Ms. Myers, are you, were you a part of the staff that worked during the March 2, 2020 General and Regional Elections?

Ms. Myers: I reserve my right to remain silent.

4. Mr. Caesar: Ms. Myers, is your office located at Barack and Fourth Streets Kingston, Georgetown?

Ms. Myers: I reserve my right to remain silent.

5. Mr. Caesar: Ms. Myers, could you please state your present address.

Ms. Myers: I reserve my right to remain silent.

6. Mr. Caesar: Ms. Myers, do you have any supervisory control over the… of GECOM Headquarters.

Ms. Myers: I reserve my right to remain silent.

7. Mr. Caesar: An interview was done with Mr. Keith Lowenfield. Do you know Mr. Lowenfield?

Ms. Myers: I reserve my right to remain silent.

8. Mr. Caesar: In that interview Mr. Lowenfield was asked for certified copies of the SOP used to make two (2) declarations in the March 2, 2020 General and Regional Elections. He said he was on leave and we must ask you for those documents. Are you in possession of those documents?

Ms. Myers: I reserve my right to remain silent.

9. Mr. Caesar: Ms. Myers, the police need those documents to conduct an investigation. Your holding those documents could cause you to be charged for obstructing an investigation.

Ms. Myers: I reserve my right to remain silent.

*Insp. Stephens intervened at this time to clarify with Mr. Caesar whether the documents he is referring to are the SOPs.

10. Mr. Caesar: Ms. Myers, when last you went to work at GECOM office at Barack and Fourth Street?

Ms. Myers: I reserve my right to remain silent.

11. Mr. Caesar: Ms. Myers, are you living at the address on the record at GECOM office for you?

Ms. Myers: I reserve my right to remain silent.

**Mr. Caesar then indicated that was the end of the interview unless Mr. Stephens wanted to ask anything further. Mr. Caesar, especially, was visibly frustrated by Ms. Myers responses. Mr. Stephens signalled to Mr. Caesar for them to speak outside. They asked for an excuse. They returned to the room a few short minutes after.

When they returned to the room Mr. Caesar said as follows:

Mr. Caesar: Counsel, I will not have to put an allegation to your client for perverting the course of justice.

Mr. Caesar: Ms. Myers: It is alleged that you are perverting the course of justice and as such you will be placed in custody. During the course of the investigations we will have persons to confront you with.

Mr. Caesar then invited Ms. Myers to exit the room where he placed her in the custody of Women Inspectors Castello and McBean whom he instructed to book her and take her to Beterverwagting Police Station.
I maintain that at no time did ASP Caesar, Insp. Stephens, or any other police officer, on or off camera, put the allegation of ‘conspiracy to defraud’ to Ms. Myers.

You wish.   It's amazing how the PPP can control the GDF formed by the PNC. Look how the Police started to do their jobs. All PNC crooks are being arrested without delay.

Recalled our household being woken up around 5 AM  one morning ,in early 1960's ,we were told to assemble in one place ,while the British soldiers ransacked the house ,and searching in a water pond .I was 10 yrs old .I still remember the event ,hearing the chopper noise over the rice fields ,then soldiers invaded the house.

That was 1962 and I was 16. I played rugby with the British Soldiers at Cove and John. They told me that all they wanted was to get rid of the communist red flags in people's yards. I had to explain to them that it was of religious importance to Hindus in Guyana.  Then they stopped.

Don't believe Rama's nancy story. The British learned from the Hindus of how to carry the Red flag as illustrated in the Ramayan and the Bhagwat Gita. The Mace that they used in Parliament is Hanuman's Gada. Without that, parliament cannot start.

Mingo, lowenfield, this woman and those police people guarding the counting station are seen by the majority of black Guyanese in Guyana and overseas as helping their race the black race. Now they are being seen as sacrificing for their race because they are being persecuted by the inferior koolie.

Roxanne Myers granted $300,000 bail

Guyana Elections Commission’s (GECOM) Deputy Chief Elections Officer (DCEO) Roxanne Myers, this morning, appeared at the Georgetown Magistrates’ Court to answer two charges of misconduct in public office.

Myers was slapped with two counts of misconduct in public office charges regarding the March 2 election. She was granted $150,000 bail on each charge. She was granted bail in the sum of $300,000 for both charges.

She is expected to make her next court appearance on October 23.

Myers was arrested on Tuesday after she surrendered to the Criminal Investigations Department (CID) Headquarters moments before the Police Force issued a Wanted Bulletin for her arrest.

The Police had said ranks have been trying for over a month to question the DCEO in relation to its ongoing probe of electoral fraud following the March 2 polls.

The police had said that DCEO was arrested for the offence of “conspiracy to defraud” and that when she was told of the allegation, she exercised her right to remain silent.

But Attorney Ronald Daniels, one of the lawyers representing Myers, refuted the account provided by the Police Force, contending that his client was arrested for “perverting the course of justice” – something which the police had denied.

She will get her day in court because she has good lawyers representing her. She was in hiding and she knew this was coming, especially after Mingo and Lowenfield.

If nothing comes out of these charges (assuming due process was denied), its important to establish that riggers will have to face consequences. There was a reason why Patterson felt it was important to get her into GECOM. GECOM need to be revamped and reconstituted.
