Opposition no-confidence motion on Rohee hits legal hurdle – minister has to be allowed to serve in Parliament state legal luminaries

The Speaker of the Nation Assembly, Mr. Raphael Trotman has reportedly been advised by senior legal luminaries that the National Assembly will have to continue to allow the participation of Mr. Clement Rohee as the Minister of Home Affairs.

Speaker Trotman at the last session of Parliament had said that he was going to seek legal advised on the status of Minister Rohee following the opposition’s no confidence vote.

Legal sources indicate that from the beginning it was clear that the no confidence motion was non-binding and only the President of Guyana can remove a Minister of Government.

At the last session, the Opposition booed and interrupted Minister Rohee from tabling a bill. The opposition APNU/ AFC has maintained that it will neither allow nor give support to Minister Rohee’s or the security sector Parliamentary activities.

However in light of this reported legal development it is not clear whether the ANPU/ AFC opposition will rethink its position or continue to act extra-legally as it relates to the no confidence motion against Minister Rohee.

The AFC heeds to highlight these totalitarian rules that makes the President omnipotent in what is supposed to be a democracy. If the official forum of his peers cannot sanction him for indiscretions or incompetence or lack of confidence as to his fitness then they are faced with a democratic deficit. Parliament ought to be unfused from the authority of the president for us to develop into a liberal democracy.

The joint opposition had already past their no confidence motion against the minister even before the commission of Inquiry began, to date there no evidence linking the Minister to the opposition instigated protest in Linden than led to the unfortunate death of the trio. We know they have no power. The point is should that be allowed in a democracy? The PPP embrace the constitution of a dictator with his cold dead hands as though he is still here.

If we are to be free of this brand of totalitarianism we need a liberalization of or democracy. In their 20 years they have become more tenacious than a skunk for its stink to keep the dictator's hand on our necks. Not one damn thing was done to facilitate a flowering of democracy in all that time.

We remain a race based Leninist system with the PPP as our vanguard party and every 4 years we go through the farce of elections to elect them as our dictators. Guyana is possibly the only state in the world where the detritus of the old soviet era still remains creed in a party.

That has to end even if it means a guyanese spring pf mass sit down in the streets to do it.

It matters not whether it is binding or not. It is necessary to raise issues that are problematic to highlight the lack of political voice and exit strategies in parliament.

SPEAKER tolerates opposition’s lawlessness in Parliament: - Legal experts advised minister should be allowed to speak uninterrupted.
Any surprise here? Hell no. Why? The Speaker of the House Raphael Trotman is AFC. He is in opposition to government who came from opposition PNC.
If the PNCR charade to call on

government to remove Clement Rohee continues in Parliament with the blessings of Speaker of the House, Raphael Trotman, then he Trotman himself must resign.
Trotman had his chance to tame the PNC tempo or have the PNCR removed from Parliament so government can continue with the people's business and Trotman failed.
No one should ask if members of the AFC took part in drowning out Rohee in Parliament. Those who were there knew they were.
Failure by the Speaker of the House,the AFC’s Trotman to rein in opposition antics in Parliament alone tells the big picture that the AFC are in cahoots with the PNCR in the streets and in Parliament.
Yet again total silence from Ramjattan and Nagamoottoo! Will Ramjattan and Nagamoottoo go into the areas they grabbed all those votes last election and tell the people there that they are not in the PNCR camp?
Will Ramjattan and Nagamootoo also tell those who voted for them that they had nothing to do with them being beaten, injured robbed and terrorised on the Agricola public road?
Next on the AFC’s agenda, which is now the total mouthpiece for the PNCR, will be the Timehri area illegal squatters.The AFC will create their next episode there just wait and see.
Those who voted for the AFC must ask themselves if this is what they really voted for. Ask themselves when last they heard of drop VAT to 10% and increase public servant wages by 20% or more and cut the Berbice Bridge into four pieces and fling it in the river.
That was the AFC’s big campaign mojo during the last election. Where are the Sasenarine Singhs and the Tarron Khemrajes who were pushing the AFC agenda?
Are they now too ashamed to speak out on their AFC joining at the hips with the PNC?
Or perhaps they too are sidelined and irrelevant to the AFC like those of Ramjattan and Nagamoottoo since Nigel Hughes took over their AFC?
Are their memories that short that they forgot the race card that was played out by Raphael Trotman against Goomatie Singh in favour of Chantal Smith?
Are their memories that short that it was the very own Raphael Trotman and his PNC cohorts masquerading as the AFC who tried to sideline Ramjattan on the leadership rotation basis?

LAST week's session in Parliament ended in an uproar due to the sick, unprofessional and lawless behaviour of the opposition.

They, in concert with their continuous heckling and banging on the desks prevented the Home Affairs Minister from presenting his bill before the House. This disorderly conduct is symptomatic of the opposition whenever they want Parliament to pay attention to what they deem as important; whenever they want to have their way.
The objective behind all of this is to have Minister Rohee ejected from the Assembly (something that is not going to happen) and they are going about it in the most degraded way possible. The Speaker instead of restoring order in the house calmly adjourned Parliament for a November 22 meet.
Like the lame duck Speaker that he is, Trotman instead of slapping a suspension on the misfits he in turn did the silliest thing imaginable, that is, adjourning the noble Assembly. This came in the wake of sound legal advice which indicated to the learned Speaker that the minister in question must be allowed to present his bill uninterrupted. In essence, what the advisers were telling Trotman was to rein in the opposition. The business of the Assembly should not be disrupted by a bunch of losers. If they want the minister's resignation there are legal avenues to do so, but to descend to such low levels of behaviour is totally unacceptable.
Certainly, what the opposition was doing was unconstitutional as Standing Order 47 is clear on this. Therefore, a sanction by way of a suspension of the offending members of parliament should have been issued forthrightly to stop the nonsense. A violation of the standing order required that form of punishment but, the speaker who is either plain stupid or just a yard fowl like his comrades chose to allow the foolishness. When a standing order could be so flagrantly disregarded the speaker should have been more assertive and taken firm action. But as I said, Trotman by his weak, jellyfish action has allowed the opposition yet again to bring parliament into disrepute.
For someone holding such high office Trotman lacks the testicular fortitude in maintaining law and order or to see to it that parliament functions in a decent and civilised way. He needs to be removed from the office of speaker.

Rohee has been advised to get some stress leave and not attend parliament from the next few sittings. Under his tenure, there are over 200 unsolved murder cases. That's quite a historical legacy for the Guyanese Book of Records.

Government of Guyana - PRESS RELEASE

The Government of Guyana has noted with grave concern the recent utterances of the Leader of the main Opposition and the People’s National Congress (PNC), Mr. David Granger, regarding the Honourable Minister of Home Affairs, Clement Rohee. Mr. Granger boldly proclaimed that he and his Party are currently mulling other ways of getting rid of the Honourable Minister following the failure of the no-confidence motion they brought to the National Assembly.

The Government views Mr. Granger’s comments as reckless and can only be interpreted as a threat to Minister Rohee.

The Government calls on Mr. Granger to explain what he meant by his comments.

We hope that the opposition is not planning to instigate what they did at Linden and Agricola. Our people want to get on with their lives in a peaceful atmosphere.

The Government of Guyana is disappointed that the Leader of the Opposition has taken this irrational position. After all the Linden Commission of Inquiry which the opposition supported to be established has not completed its work. Moreover the evidence which have been led so far do not implicate Minister Rohee in any wrongdoing.

The opposition is also in possession of the legal opinion that the Speaker solicited from Senior Counsel Mr. Rex McKay and Mr. Steven Fraser.

History is replete with the economic and human consequences of such irresponsible threats and its subsequent protests orchestrated by the Opposition which inflicted many hardships and pain on citizens. In view of this, the Government wishes to pellucidly state that Mr. Granger and his Party will be held fully responsible for any action they intend to perpetrate against Minister Rohee and any attempt to destabilise the country and the democratically elected administration.

The government calls on ALL democratic and decent-minded Guyanese to reject this latest attempt by Mr. Granger and the PNC/APNU to once again threaten instability with the intention of reversing the developmental thrust for narrow political objectives.
