The acting Chief Justice Roxanne George, SC, ruled that Government did not follow the procedure outlined by the Constitution of Guyana to challenge the status of the election former AFC MP Charrandass Persaud as a Member of Parliament in the National Assembly. The method according to the Constitution is that an elections petition had to be filed no later than 28 days after Persaud’s election in the National Assembly.

Information was not available just before the Chief Justice was to make her decision.
It will be important, of course, to know the decision plus in time what actions will be followed by the interested parties.

Is Justice George related to Anglican Bishop George. Bishop George was a strong anti PNC.

Dual citizenship is a separate matter which must be handled henceforth.
Focus of this case is the vote which occurred on December 21, 2018.
Base, the law is the Law, I guess it will be the job of the Speaker and his Staff to enforce it.

The vote of former APNU+AFC MP Charrandass Persaud which brought down the government in a vote of no-confidence on December 21 is valid, Chief Justice Roxane George ruled this afternoon.
Persaud’s vote had been challenged by citizen Compton Reid. It was one of several planks seeking to overturn the vote of no confidence.

Chief Justice (ag)Roxanne George-Wiltshire on Thursday afternoon ruled that the no confidence motion, which was voted in the National Assembly last December, was carried.
The Chief Justice in her ruling, said that 33 persons are the majority of the elected Members of Parliament (MPs).
On the issue of dual citizenship, the Chief Justice also ruled that the vote of former APNU+AFC MP , Charrandass Persaud was valid even though he was occupying a seat in the National Assembly illegally or against constitutional provisions of the state.
Attorney General and Minister of Legal Affairs,Basil Williams subsequently applied for a stay of the judgement passed by the Chief Justice as well as a conservatory order for the government to remain in office until the appeals are heard.
The Attorney General told reporters that government “is going all the way ” as he noted that the case will be appealed all the way to the CCJ .”There is nothing to panic about or nothing to worry about,” he said.”We haven’t lost an election , we will go through the court system,” he said.
Williams reminded that in the Presidential Third term case , the Opposition received favourable judgement in the High Court and the Court of Appeal but lost its case at the CCJ.

Since PNC lost the NCV and even believed in it that they took it to court and lost again !
