PPP/C to block swearing-in of Mayor, Deputy

0The Opposition People’s Progressive Party/Civic (PPP/C) says it will be moving to the courts today to block the swearing-in of the Mayor of the newly-created town of Mabaruma, Region One (Barima-Waini) who was selected by Communities Minister  Ronald Bulkan, contrary to the Municipal and District Councils Act Chapter 28:01.PPP
In the municipality of Mabaruma, the Opposition PPP/C and the ruling A Partnership for National Unity/Alliance For Change (APNU/AFC) each snapped up six seats on the Council – leading to a tie when the Council voted on Saturday and Tuesday to elect a mayor.
In an instance like this, Chapter 28:01 Section 13 (6) provides that the Town Clerk shall appoint a date for the election of a Mayor by the people. This date shall not be later than December 28 of the same year.
However, without that vote, Minister Bulkan applied Section 13 (4) which states “where at an election [as prescribed above], two or more Councillors secure an equal number of votes the Minister shall direct which of those Councillors shall perform the functions of the office of Mayor; and that Councillor shall assume and perform those functions until such time as the Mayor or Deputy Mayor as the case may be is able to act.”
The Minister named APNU/AFC Councillor Henry Smith as his choice for the post of Mayor.
Following this the six APNU/AFC Councillors elected Ashtrilla Gammel, another APNU/AFC Councillor as Deputy Mayor.
Speaking on Bulkan’s action, former Attorney General and Legal Affairs Minister Anil Nandlall said that his Party would be moving to the courts this morning to block the swearing in of the two “unlawfully-appointed” officials.
“We will restrain them from functioning and we will quash the appointment. We will seek the courts’ intervention to seek an order that will prevent them from acting in office or secondly quash the decision that appointed them,” Nandlall told Guyana Times Tuesday evening.
He said that the Minister clearly violated the law and has acted precipitously and prematurely by making appointments without going back to the electorate as the law dictated.
“In other words [he] has usurped the functions of the Guyana Elections Commission (GECOM) and certainly violated the law and it is an attack on democracy, it is stealing of the will of the electorate; the people are required by law to go to an election again and only when it fails to yield a result or yield a tie result, the Minister’s powers are activated,” the former AG explained.
Bulkan also went ahead and named the Chairpersons for some five Neighbourhood Democratic Councils (NDCs) where there were also ties between the APNU/AFC and the PPP/C.

First of all, thee is nothing wrong with the PPP challenging Bulkan's action. This is politics. Regardless of what anyone of us here feels about the PPP, they believe there is a legal basis for a challenge. 

Second, whether the PPP refused to call for LGS in 22 years, the fact remains that the PPP was democratically elected to  office. However, it remained a minority government under Ramotar with control of the Executive.

Third, you seem to think that history in Guyana began in 1992. Do you have any idea of the problems in Guyana before this period?

Fourth, if I remember correctly the Rabbi and House of Israel people were thugs supporting Burnham and his racist government. They were involved in killing opposition people, like WPA members. The House of Israel was not a creation of the PPP. Maybe people in this site can correct me If I am wrong.

Your words clearly demonstrate a deep seated bias in what you write.

The LGE rules provide that if the councilors cannot agree on who should be elected as a mayor, then the Minister responsible for LGE is then allowed to act as the tie breaker by making a selection.

If Bulkan had selected a PPP candidate and APNU AFC threatened court action, you would be screaming about how dictatorial the PNC is, and that they should accept the will of the people.

The PPP is well aware of the rules.  The PPP is also aware that it disbanded many local government entities and put in place officers of their own choosing. 

I very much doubt that the PNC (or the remnants of the GGG) had any input in determining the selection of Carol Sooba, or the other actions taken by the PPP to circumvent those who were elected into cou8ncillor positions in 1994.

I hope that the idiots who fell for the Jagdeo scam that the PPP "won" the elections, you being one of these folks, now know better!

1.  Hoyte arrested many of these people.

2 Jagan RELEASED many of these people.

3. Jagdeo promoted some into top PPP slots, with some even becoming MPs.

4.  Why didn't you chat about the fact that Roger Khan and the phantoms played the same role under the Jagdeo era.

The PPP installed IMCs everywhere they can....the selected everyone so what was smart about that? Why do they now object procedurally when the walked all over those procedures?

In Mabaruma half of the councilors are APNU AFC, and half are PPP.  Each voted for their own candidate, leading to a dead lock.

The rules are that when this happens the Minister then selects.

Now tell us what rules did the PPP obey when they refused LGE and forced down undemocratic IMC, who didn't do anything?
