In Guyana, lawyer Anil Nandlall who represented the CEO & Manager in this matter also MISLED HIS CLIENTS, he ALSO displayed conduct that can definitely bring the legal profession into disrepute!
But unlike the actions taken in the UK, despite Nandlall's KNOWN Unethical conduct, he (like the DPP et al) has been "rewarded"; he was appointed Attorney General (AG)!
NB: On June 1st 2007, lawyer Nandlall was recommended after Moen Mc Doom (see other posts below) phoned Arjoon at 5.45 a.m. and said "get a lawyer, you and the 2 Managers will be charged for fraud" & hung up! (Several years later, it was discovered that Nandlall was very close to President Jagdeo and helped in the delaying of the criminal matter for 4 ½ years and also BETRAYED his clients. Note:
Although Nandlall KNEW; had PROOF that his clients were innocent, he did NOTHING about the blatant/unacceptable delays by the Prosecutor nor the MISLEADING /INCORRECT statements by Mc Doom & Gopaul although subjudice etc. Nandlall himself would frequently not attend court, telling his clients that they were innocent and that the matter would eventually be dismissed.
Nandlall assured his clients that aspects in the writ filed in the high court, such as the required payment of 75% of their salary, was included, which was later found to be DELIBERATELY OMITTED although he was reminded verbally, by email and even by a neighbor and SAID it WILL BE DONE!
When one of the perpetrators of the scam was found, the DPP then charged the CEO & 2 Managers with conspiring with them although no link whatsoever! Yet after Nandlall took the matter to the high court and Chancellor (ag) Carl Singh gave the DPP 2 weeks to show cause why the CEO & Managers were charged, and although Nandlall KNEW that the DPP never had any cause, instead -without reason - told them to drop the matter in the high court (it was later revealed he was asked by "higher persons" to this); then helped to delay the matter further!
Mr Nandlall was however extremely vocal to the media on the blatant wrongdoings such as: “What the DPP is doing is PERSECUTION..not Prosecution” etc (see more under comments). Yet, Nandlall as the AG defended the DPP against Arjoon's lawsuit for Malicious Prosecution, which was done by asking for adjournments for over a year without providing a shred of evidence why the DPP charged Arjoon. YET, the case was DISMISSED and after OVER 10 MONTHS JUDGE DAWN GREGORY HAS NOT WRITTEN THE DECISION HENCE THE APPEAL CANNOT BE HEARD!
Separate posts will continue to be made on every one of those involved in this EVIL INJUSTICE which is continuing after almost SEVEN YEARS with the ILLEGAL withholding of Statutory payments/pension & benefits due. The NBS Board "say" its because the victims were negligent when the Board has been negligent by repaying the account holder who with her husband and the Dep CEO etc received proceeds of the withdrawals made hence NO FRAUD- all of which & MORE can be proven in an Independent Investigation!
