Got a ticket couple months ago from a crooked cop who was driving at about 30 mph in blinding rain and was about 500 feet from an intersection where I made a right turn.  He claimed that I did not come to a complete stop before turning right at the intersection.  Swear to gaad that I did stop, observed the cop coming and decided to turn because I had a safe distance.

 

So about a month ago they asked me if I wanted a plea bargin for “Parking on a Pavement” and I said NO.  So we went to trial today.  I was representing the defendant ME

I had about 4 pages of cross questions for the cop plus I called my wife as witness.  I rattled the cops ass on the stand.  First he said that he was less than a 1,000 feet away from the intersection, so I asked him if he could observe a vehicle coming to a complete stop for 1 second from while driving at 30 mph from 1,000 feet away in blinding rain.  He then said "oh, I was 500 feet away."  So I showed him a picture that was taken about 200 feet away and he could not identify the intersection because “he was closer than that.”

 

Bottom line the defendant got convicted  How can you win? The fine was $50 plus surcharge whereas the plead bargain fine was $150 plus surcharge.  I had a ton of fun defending the defendant me

The courts have no mercy bai you don't know dat?  It is all about making money.  So I had a Judge, an assistant district attorney and the crooked cop there for 1 hour.  It was well worth the $50 fine...frankly I didn't care what it would have been because I am not pleading guilty for something I did not do.

In TO you would also  get 3 demerit points and it would affect your insurance.

I got that too, but who cares.  That's the only thing I could have avoided with the plea bargain, but I wasn't going to accept.  Note that my fine was lower than the plea bargain fine.  I thought that was strange.  I think the Judge knew I was not lying but he had to side with the cop, that's why the fine was so low.

Congrats for standing up to corrupt cop.

 

In the end, you won because you had your day in court and faced the corrupt cop and gave him shytings.

 

The judge had to side with the corrupt cop in order to prevent any precedence being set.

He got me while I was overtaking a truck and trailer. He was a prick, I told him I see him in court, anyway my daughter will represent me.

One of my biggest wins was taking a large vehicle dealership to court, after charging me $411. for 'repairing' my natural gas van, by their fully trained mechanics and not fixing the problem.  This was repaired by replacing a $15.00 relay, at a corner gas station.

 

My biggest satisfaction was dragging four managers and mechanics to court, where I represented myself. They were not productive on their jobs, while I was given paid time by my employer.

 

The judge ruled in my favour, that  was published in the local paper, with letters to the editor supporting my claim.

 

It would have been cheaper for the company to reimburse my $411. from the business they might have lost, due to negative publicity.

 

If I had lost with court cost, it would have still been a win for me.

Most likely, he would not show up.

It is BS that radar units does not retain the display. Its a legal requirement for it to do so and for the driver to be shown.

I went back through my training notes and drafted road maps with technical information.

 

On the day before the court session started, the police officer noticed  my paper roll and inquired about it.

When I told her I repaired and tested the type of unit she used, a few minutes later she said, this is your lucky day, because they decided to drop the charges.

 

KP, let me know if you need any technical help. Dialog me. 

 

Some police officers ego works overtime.

Most officers allow safe overtaking with a slight speed increase, I was given a warning for doing the same.

Exact thing they did me 15 years ago when I had my last ticket before this one.  I overtook a guy driving about 50 mph in the 55 mph lane, the cop clocked me at 70 mph.  I couldn't fight it, but that was a cheap blow.

It looks like cops wait behind a slow moving vehicle, to clock someone trying to pass.

Remind your daughter to subpoena the maintenance records of the specific radar gun. A lot of times the police are lax in maintaining their equipment as per legal requirements.

Got a ticket upstate NY for doing 80 while overtaking a truck and car....wrote to the county and plead non guilty. They got my letter and reduced it to parking on pavement or something like that...avoided the points...

Excellent point.

As a legal requirement in BC, before every reading is taken the older models have to be recalibrated, with a tuning fork. New models will have a similar electronic feature.

Mtce record could upset a case, if a person know how to ask the right questions.

 

Without seeing the radar gun  how do we now ID the right gun. They are randomly handed out to different officers, but delivery record could ID the correct gun by serial or police number, like their vehicles.

Years ago while on my way to the beerstore whaich was about to close,I got myself off a charge of not wearing my seat belt and making a making an assinine lane change (something to that effect) he really couldn't explain the move I made,you'll see why in a moment.

 

In court I asked the cop this question, "Where were we parked when I received this ticket? He replied with, "the parking lot at Brimley and Sheppard"

 

Case thrown out. The reason for this was because no one can get a ticket for no seatbelt and making an asinine move when in fact they were in a parking lot?

 

By the way, I was not wearing a seat belt and the asinine move I made was to overtake a slow ass driver, I used the oncoming lane. The cop just happened to be driving an unmarked in the right lane, there was a car beside him in the left lane and I was behind that car,suddenly he saw me in front of the guy who was driving on the left of him.

He pulled me over and that's when I pulled into the parking lot.

 

 

Another time I was given a ticket for running a red light.

I went to court and during the proceedings the Judge asked me where was I when the light turned red and I told him I did not see it turn red,it was amber as I went through and far as I recall, amber doe not mean stop...proving I had to have been on the other side of the street when it changed to red...case thrown out.
