Speaker disallows Motion to add Exxon US$18M bonus to Consolidated Fund

Before the passage of the 2018 budget, Speaker of the National Assembly, Dr. Barton Scotland, yesterday, disallowed a motion of adjournment from the People’s Progressive Party/Civic (PPP/C) seeking to have the US$18 million signing bonus paid by ExxonMobil transferred from the Bank of Guyana to the Consolidated Fund.

On the final day for the consideration of the estimates, the PPP/C Members of Parliament, Irfaan Ali, and Gail Teixeria, through the motion, sought to have the National Assembly direct Minister of Finance, Winston Jordan to amend the estimates of revenues and expenditure to reflect the signing bonus.

Opposition Leader, Bharrat Jagdeo presented the motion in Ali’s absence. The Motion set out to seek the adjournment on a definite matter of urgent public importance.

The House was scheduled to start at 10 a.m., but didn’t get underway until shortly after 13:30 hours.

Dr. Barton in his ruling stated that the motion of adjournment on a definite matter of urgent public importance is an extraordinary procedure and that the Standing Order that guides the Speaker sets out three indispensible elements– that the matter must be definite, urgent and it must be of public importance.

β€œOf the existence of all three elements, the Speaker must be satisfied,” Dr. Barton stated.

He shared that the matter appears to be definite and of public importance. However, the Speaker ruled that it did not satisfy the β€˜urgent’ element since the matter of the signing bonus was raised a week ago in Parliament by Finance Minister, Winston Jordan, and Raphael Trotman, the Minister of Natural Resources.

β€œThe Honourable Members who have sought to move the suspension of the business of this House through the extraordinary procedure of this adjournment motion appear to have approached the House some seven days after they were made aware,” the Speaker stated,

He noted that consideration of the estimates continued over the seven days, yet the members approached the House with the motion on the final day of the process.

β€œThe Speaker holds that the urgency envisaged in the Standing Order is not represented by this application and consequently disallows the application,” Dr. Barton ruled.

The motion sought to have Jordan deposit the money into the consolidated fund in compliance with the laws. It was noted that the current revenues and expenditures do not reflect the receipt of the monies and are therefore understated by US$18 million in violation of the Constitution and the Fiscal Management and the Fiscal Management and Accountability Act.

Essentially, by the motion, the estimates are unlawful, illegal, unconstitutional, null, void, and of no legal effect.

In the motion, Ali points out that the signing bonus was only publicly disclosed and admitted to by the Government less than seven days ago.

According to the motion, the monies were deliberately not entered in any formal accounting records of Guyana. Specifically, the motion pointed out that Article 216 of the Constitution of Guyana mandates all revenues or other monies raised or received by Guyana shall be paid into and from one Consolidated Fund.

This is applied in most cases except when revenue that are payable, by or under an Act of Parliament, into some other fund established for any specific purpose or that may, by or under such an Act, be retained by the authority that received them for the purpose of defeating the expenses of that authority.

Opposition Leader, Bharrat Jagdeo, has signaled his party’s intention to mount a legal challenge against the decision of the Government to have the monies sent directly to a β€˜special’ account at the Bank of Guyana. The Government was forced to admit the existence of the US$18 million bonus after a letter was leaked indicating that the Ministry of Finance directed the Bank to set up the fund for the bonus.

Jordan has since indicated that the monies were received in 2016.

Django bai. I will give you a good advise this Christmas season. I understand that you have a problem with how Jagdeo operated while he was President. That is now old history as he is no longer President although he is now the Opposition Leader. He is doing what Opposition political parties are paid to do. Oppose the actions of the government. Happens in America all the time. The Republicans opposed everything that Obama proposed. Yet today they and Trump are complaining that the Democrats don't support them. Jagdeo is doing exactly what is standard of Opposition political leaders. So while we don't have to forget what he did, it is not as important or as urgent as what the government do now. It is looking like you are offering excuses for the current government and that will only put you in a bad light. The current government has already sacrificed all of their goodwill. Don't fall into the trap of having yours sacrificed also. Sure Granger's government has goofed up and they got caught. You stated that they are correcting their mistakes but I don't see where they are doing this. The motion today is to have this bonus included in the 2018 budget which the Granger government failed to include. But since they received the bonus in 2016, they have now excluded it from two budgets, the 2017 and 2018 budget. So where are they correcting their mistakes? Now Trotman is more concerned with which of the few insiders leaked the memo rather than that they did something wrong. So where are they correcting their mistake. Does correcting their mistake means finding out who leaked the memo and settling a score with that person?

Again, don't allow your goodwill to get sacrificed by Granger and his compadres' wickedness. You can still oppose this government while still opposing Jagdeo as that is your right. Pranama.

Strategically, the PPP are dumb bunch still guided by the stupidity of the Jagans.  Imagine dem cussing the US ambassador. Stupid as stupid comes.  Hear this, the PPP ain’t getting back before 2025 and not with Jagdeo or any of his henchmen/women. Nah. I was born in the year that the PNC wrecked havoc on Guyana and all my life in Guyana was spent under an  ever growing repressive and dictatorial PNC regime and it is from that foundation that I will never support the PNC. Decades later into the present, the PNC is still a bunch of bullies. I don't have any experience living under the PPP government so I don't have the same anger towards them. But I have had many neighborly meetings with Cheddie and Janet and they were all very cordial and warm.

Regarding ethnocentric. I never saw the PPP and PNC as Indian and African as they both had major players from both major parties. That is why you don't see me referring to the parties in racial terms. I rail against Moses not because he is Indian and part of the current government but because he himself claimed that he would have to be a neemakharam to do so. All I do is reiterate his assessment of himself. Remember it was an Indian Speaker who used to throw Jagan out of Parliament for no good reason. Fast forward and we have the same tenement yard behavior from Scotland regarding Edghill. Different times, same PNC bully tendencies.

You are perfectly entitled to your position sweetheart. I am a US citizen and seek the best for America if not so much for myself anymore, for my kids as they seek their place in world. That as my preoccupation does not allow me to lose sleep over Guyana which I turned my back on 31 years ago. I have lived in America much longer than I did in Guyana and truthfully, America has been tremendously good to me and my family. Priya doesn't have that same experience so she acting in what she thought is the best interest of Guyana would have to be evaluated through that viewpoint. I really only started railing against the AFC after they signed that Valentines Day love letter. After declaration comes sex. After signing that love letter, the AFC got screwed by the PNC. Now they are walking around beaten and bruised.
