Breaking: Jagdeo summoned to court for Babu John remarks

Former President Bharrat Jagdeo has been summoned to appear in the Whim Magistrate’s Court on April 20 to answer a private criminal prosecution that he uttered racially divisive remarks at Babu John.

A summons was issued by magistrate Charlyn Artiga and will be served on Jagdeo  at his Sparendam address although it is understood that Jagdeo is currently in Canada. He will be required to appear personally in the court and plead to the criminal charge.

The private criminal prosecution was this morning filed by lawyer Chris Ram in his capacity as the informant in the Corentyne Magisterial District and reads that on Sunday March 8 Jagdeo made statements to the public at large at a public meeting held in Babu John Corentyne…”which can result in racial or ethnic violence or hatred among the people”  as set out in Section 139 D of the Representation of the People Act.

Under the Act, if found guilty Jagdeo faces a fine of $100,000 together with imprisonment for two years. The Director of Public Prosecutions does have the power to withdraw the private charge, however it is understood that any attempt to do so would be met with strong legal challenges.

In his court filing Ram states that Jagdeo said: ” The opposition consistently shout about the racism of the PPP but they practise racism. The opposition beat drums at six in the morning and say let us throw out those coolie people.”

Yesterday GECOM’s Media Monitoring Unit in its first report chided sections of the media for publishing the comments because the unit “verily concluded that the remarks made by Dr. Jagdeo were racially divisive.”

Jagdeo is a private citizen and not the president. So he is not protected by the constitution. You guys should read the constitution properly before opening your mouth about what's in it.

Indeed, it is a gross misinterpretation and colossal misuse and abuse of section 139D of the Representation of the Peoples Act, Cap1:02,” said Dos Santos, a former Attorney General and Minister of Legal Affairs in a People’s Progressive Party Civic-led administration.

Dos Santos feared that the use of the law could be used to trample on politicians’ constitutional right to freedom of expression. “I will say however, that it constitutes an abridgement of the constitutional right and freedom of my client to speak and express himself freely. Indeed, this unprecedented use of a criminal charge to muzzle speakers at public political events is an assault on the democratic right of political leaders to speak freely on matters of national interest as well as a violation of the democratic right of the citizenry to receive such information. I can only imagine the devastating consequences which can flow if the criminal justice system will be used in such a manner and across the political divide. This is nothing more than political sensationalisation and mischief,” he said.

Chief, I believe a sitting President is protected by the provisions in the constitution you refer to. A former President cannot be prosecuted for his actions as a President....but the man and the time of the Chris Ram's charge are not protected. I stand corrected though......

Running afoul of a law you assent to is the kind of karma only former Presidents can experience but that’s exactly what has happened to Jagdeo.

In 2001 he assented to Section 139 D of the Representation of the People Act forbidding speech “which can result in racial or ethnic violence or hatred among the people”. Fourteen years later he will have to answer to the charge as part of a private criminal prosecution that he broke the same law by his remarks at Babu John. It will be hard to wriggle out of: he can’t sit in his mansion and avoid being served claiming he does not know about any summons, since his lawyer today issued a press release on his behalf.  And he can’t send his lawyer either as it is a criminal charge. So he will have to go in person to the little magistrate’s court at Whim to enter a plea, barring some “speedy review” by the DPP, that De Santos calls for in his press release. And any decision by her would face a robust legal challenge.

Over to another magistrate’s court and the matter of Sam Hinds Jr. As we noted it is bizarre that the DPP indicated he should be tried again for the same offense based on the Summary Jurisdiction Procedure Act. Law that is inconsistent with the Constitution is void to the extent of the inconsistency and the Constitution is clear that someone cannot be tried for a crime they have already been convicted of (with conviction separate from sentencing).

But why would the DPP who has already secured a conviction in the case suddenly be asking for a retrial? And why would the defense lawyer not be agreeing wholeheartedly to the same retrial for his convicted client? Alice in Wonderland on Main St.

I do not doubt he is an asset to the PPP. His brazen treatment of the nations purse of his piggy bank was precedent for all of them to dig in.

 

If Moses voted for his pension so what? Parliamentarians vote party line because that is what they are expected to do. Moses surely will get the chance to vote against it or at least lobby for it

Dem two words ‘unnatural attraction’  mean that Ram want Jagdeo in an unnatural compromising way—in simple layman language, it means Jagdeo got to lie down pun he belly.
Dem boys seh that this thing nah come over as no big surprise. Is years now people use to hear this thing ‘bout Jagdeo and he unnatural attraction and style. Dem boys never see fuh demself, but it look like he lawyer know more, and hear more than anybody else fuh write such a statement.

DeSantos: Ram obsessed with Jagdeo

 

CHARGES against Dr Bharrat Jagdeo, filed by vocal critic of the current Administration, Mr Christopher Ram, are “frivolous, vexatious, an abuse of the process of the court” and represent an “unnatural obsession” with the former president.These were the sentiments of Attorney-at-Law, Bernard De Santos, who was retained by Dr Jagdeo to defend him against the charges.

“I can only imagine the devastating consequences which can flow if the criminal justice system will be used in such a manner and across the political divide. This is nothing more than political sensationalisation and mischief,” he said.
Ram contends that there was a violation of Guyana’s electoral laws, as outlined in the ‘139D of The Representation of the Peoples Act, Cap 1:02’,under which the private action was filed.
The Representation of the People Act addresses processes, actions and sanctions for breaches of various protocols.

Ram’s move also follows the pronouncements of the Guyana Elections’ Commission (GECOM) Media Monitoring Unit (MMU).
The first report since its resuscitation was released earlier this week states that at an event at Babu John, last month, Dr Jagdeo said: “They shout about racism of the PPP, but they practise racism. They whisper campaigns. In the last elections they went to some of the Afro- Guyanese villages and beat some drums at 6 O’clock in the morning and say let us throw out these coolie people. Get up, go out and vote, throw out the coolie people. That’s the kind of language they use. Anybody from our party who uses that sort of language, we will kick them out. This is our approach.”
The MMU concluded that his comments were “racially divisive” – although the Unit did say that this was “probably” not intentional.
The Unit said: “Taking into consideration the historically and politically influenced divisions that persist up to now between Africans and East Indians in this country, and which are usually more pronounced during elections periods, the Unit came to the conclusion that the anecdotal illustration used by Dr. Jagdeo to make his point about racism, boomeranged disastrously, since it came over as a calculated exploitation, for political purposes, of the known fears and insecurities of one section of the population – East Indians.
“It is within the foregoing context that the Unit verily concluded that the remarks made by Dr. Jagdeo were racially divisive,[though] probably, not intentionally.”
GROSS MISREPRESENTATION
All considered, Jagdeo’s lawyer noted that Ram’s contention is a “gross misinterpretation and colossal misuse and abuse” of the law.

He declined to speculate on Ram’s motive for moving ahead with the charge.
The lawyer said, “I will say however, that it constitutes an abridgement of the constitutional right and freedom of my client to speak and express himself freely.
“Indeed, this unprecedented use of a criminal charge to muzzle speakers at public political events, is an assault on the democratic right of political leaders to speak freely on matters of national interest as well as a violation of the democratic right of the citizenry to receive such information.”
De Santos expressed the hope that the matter will be reviewed “speedily” by the Director of Public Prosecutions (DPP).
The matter is expected to be heard before Magistrate Charlyn Artiga at the Whim Magistrates’ Court, Region 6 (East Berbice/ Corentyne) on April 20.

While Jagdeo was mischievous, I am not sure it rises to the level of high crimes and misdemeanors.  For example, posters here make such vicious and malicious attacks that will make people blush at the crassness.
