The Chairwoman is expecting a report that reflects a tabulation and seats allocation from the Certificates of Recount. The Commission has already rejected Lowenfield’s latest report.

It’s quite obvious that he not going to give her what she requested. The Commission’s only choice is to terminate his services and appoint a new CEO. The tail cannot wag the dog.

When this criterion is met, a declaration will be made.

The instructions were clear, he did not meet the request. He had several chances to make things right. He refused. That is called insubordination. He was not hired to rig elections. He was hired to organize the elections and and report on the results, the will of the people.

I don't think she would ask Lowenfield for another report because he has wasted a whole month of her time since the recount exercise has been completed. I am sure the Chairperson is regretting taking this job and would like to see it completed so she can go home to peace and family. I think Monday's meeting is to remove him from his post as CEO.

If she was leaning towards a declaration as opposed to any other Commission matter, she would have called that meeting on Sunday instead of Monday since the declaration of a President using only 4 attendees of the 7 Commission members only require 24 hours wait while other matters require 48 hours when using only 4 attendees of the 7 Commission members.

On three separate occasions he acted in contravention to her orders. That  is gross insubordination. The CEO can be discharged either for cause or not. Being discharged without requires giving him 3 months notice while being discharged for cause can be immediate. His recourse is to file a lawsuit for up to the 3 months pay that he would be denied if he is discharged without cause. But given all the evidence that he has already piled up he would have a difficult time proving that he was discharged without cause. Regardless of how/why he was discharged, he cannot file a lawsuit to get his job back so there is no need to stall anything because he is going to court.
