Supreme Court Upholds Affirmative Action | DiversityInc

A 4-3 majority ruled to uphold a higher education affirmative action program.

The Supreme Court ruled this morning to uphold an affirmative action program at the University of Texas, determining that using race as a factor in the admissions process to achieve greater diversity is constitutional.

Justice Anthony Kennedy wrote the opinion for the majority and was joined by Justices Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor.

“The Court’s affirmance of the University’s admissions policy today does not necessarily mean the University may rely on that same policy without refinement,” Justice Kennedy wrote. “It is the university’s ongoing obligation to engage in constant deliberation and continued reflection regarding its admissions policies.”

Justice Elena Kagan had recused herself from the case. Justice Samuel Alito dissented and was joined by Chief Justice John Roberts; Justice Clarence Thomas wrote his own dissent.

“Something strange has happened since our prior decision in this case,” Justice Samuel Alito wrote. “This is nothing less than the plea for deference that we empathetically rejected in our prior decision. Today, however, the Court inexplicably grants that request.”

The Supreme Court previously reviewed plaintiff Abigail Fisher’s case in 2012 but sent it to be decided by a lower court. The lower court chose to uphold the university’s program so the Supreme Court reviewed the case again.

In 2008, Fisher alleged that the University of Texas-Austin denied her admission to the school over admitting minority students, who she alleged had lower grades than she.

Justice Antonin Scalia may have had an effect on the outcome. Prior to his death he did not hold back his disdain for affirmative action.

“There are those who contend that it does not benefit African Americans to — to get them into the University of Texas where they do not do well, as opposed to having them go to a less-advanced school, a less — a slower track school where they do well,” he said.

Chief Justice Roberts previously questioned what “perspective” a minority student could bring to a college classroom.

Absolutely bull crap. Minority students do not need the world to tell them they can compete. They see that much of Americana is from their cultural legacy.

Affirmative action means you do not get to discriminate against the disadvantage. Also, every metric tells us SAT is cultural and is a predictor of first year viability not graduation potential. The world is a better place when different cultural viewpoints are in the house.

Minority students are students who are not white. I have seen a lot of Mexicans, Indians and South East Asians getting in universities. Being in the top 10% of your class entitles you for admission.

You obviously do not. It is not a lowering of standards. It is an acknowledgement that some communities are undeserved because of institutional racism and so there should be allocations in  state subsidized schools to reserve a percentage of placement for minorities.

It means that these would otherwise be filled by higher scoring students and those with marginal scores would not get in and often these are students from poor and under-served school systems.  There is no special basket weaving classes afforded them or marking on a curve to keep them in school.

Statistically they graduate in higher percentages than their white counter part. These very schools who do not want to take in these marginal students are the ones who grab up all of the athletes so they can make billions on their backs. Athletes are an example of white discrimination. Minorities  make up most of the traditional sport line up in track and field and also the high income earning basket ball and football squads. They go out of their way to dumb down the curriculum to keep these stutents on the squads yet these very schools complain about reserving placements for other students.

Asians are no longer considered a minority in higher education.  In fact, more Asians than whites are admitted to some universities based on merit.  Depending on the school's policy and the percentage of places allocated, most of the affirmative action students end up being black or Hispanic citizens of the USA.  The Nigerian students are right up there with the Asians.  They don't need affirmative action.

You are completely ignorant of what happens. The quota is a reserve placement for a set number of students to come from minority communities. It did not say stupid students. Obviously the best of them gets at these placements. These students all do well and their communities are enriched by it.

Smart white kids can always get into schools. They are better prepared, and from school systems geared to producing good students. That is by itself an white advantage. They are benefiting disproportionately on the nations wealth. Most of these school even the elite ones are state subsidized in instances.

It would be to the detriment of all communities if all the good schools are all white. In time they become deprived of information from the rest of the world any by that deficit become academically poor. These reserved and developmental seats makes for a better more diverse world.

D2 stop talking Shit.  Affirmative Action guarantee seats for a certain number of Blacks regardless of scores.  It is a lowering of the standards and the justification is history of oppression for Black Americans.  And Black from other contries like Guyana benefits eventhough they were the oppressors.  This takes away from those Blacks who makes it fair and square as everyone assumes they are beneficiaries of A A.

Seats are finite. Larger populations mean there are larger supply of excellent students. Institutional race based advantages further serve to stack the deck in their favor. It means that if there are no reserved seats the elite schools would be all white. It then mean the elite schools would be under served.

And not all high scoring minority student wants to go to white elite schools. Most want to go to historical black schools where their college experience would be culturally more fulfilling. Every black person who is who want their child to go to under graduate at Howard, Morehouse Meharry, Chaney, Texas southern etc.

The  creation of developmental programs and reserved seats for minority students is advantageous to these universities in that it brings a diverse point of view to the student body. The pool of minority students from these institutions are dispersed across the world creating information networks that benefit the universities.

One of the remarkable thing about going to Howard is one can meed a Tibetan student or a Navajo or a Yoruba, or an Algerian or a Frenchman. It is said if you sing the fight song in any capital someone will answer back. There is value in such interconnections. It truly makes for a world community of intellectual cooperation and information sharing and accretion.

D2 is correnct of the purpose and intent of Affirmative Action but Bibi is correct, it waters down the educational system by lowering standards to meet a quantative outcome.  Many White and Asian/Indian students are sidelined so Blacks (with lower scores) can get the reserved places. d2 talk aaa lotttt of shyte to confuse the issue and hope to win by a "war of attrition"!

Sir, there were no special courses in physics at university of Pennsylvanian for minority students. No special Mathematics class was set up for them. The university has great support system beyond what a regular CUNY school may have so the student excels. It is community that produces excellence.

These universities have their inherent problems. They are filled by upper class so their social and cultural focus are different. One can easily feel out of place because what is normal for them is not normal for the average student. Some students suffer alienation. They have a special name for them "imposters".

This is not only a minority experience but a poor white experience. Many drop out not for lack of ability but for sense of disconnection with the social ethos. Minority students are a great benefit to places like these. They do not dumb down the place but increment its cultural experience. There is no war to win. There is just the truth to be told. No elite school is made poorer by the presence of minorities.

I know of an African American kid  who grew up in Northern NEW JERSEY, he chose an all black  University, I think it was in Delaware.  After one year he took  CUT AND RAN,  He told his mom it was too gettho

I know of an African American kid  who grew up in Northern NEW JERSEY, he chose an all black  University, I think it was in Delaware.  After one year he took  CUT AND RAN,  He told his mom it was too gettho

I have never seen a historically black college that is "ghetto" and I have visited many of them. That is pure nonsense. To the contrary, if you go to these schools you are in a relentless cultural content stream. Howard which I know is fashion runway any day. It is as far from the ghetto as you can get. These are reservoirs of creativity in every hallway. Practically every black person you can see in the media came from one of these schools.

The  creation of developmental programs and reserved seats for minority students is advantageous to these universities in that it brings a diverse point of view to the student body. The pool of minority students from these institutions are dispersed across the world creating information networks that benefit the universities.

One of the remarkable thing about going to Howard is one can meed a Tibetan student or a Navajo or a Yoruba, or an Algerian or a Frenchman. It is said if you sing the fight song in any capital someone will answer back. There is value in such interconnections. It truly makes for a world community of intellectual cooperation and information sharing and accretion.

There are no black colleges in Delaware!!  And there is no such thing as an all black university.  All the historically black colleges in the United States have non black students as well.

Actually, Meharry and Howard Medical and Dental Schools might  have to reserve seats for minorities or they would be mainly white.

This African American kid went to high school where the majority of his schoolmates were white. So to him the the all black college was ghetto.

Let me make it clear...whether he went to Andover where my wife went and was brought up in the bosom of Jack and Jill America he would be an ass if he thinks any of these schools was ghetto.

Look the kid grew up with being mixed and it can be a culture shock to be with all of his own.

I heard Guyanese Indian doctors who went to study in India echoed the similar sentiments, not about Ghetto , but too many of one.
