The Chairperson of the Guyana Elections Commission (GECOM) has given an undertaking to the Court, orally and in the form of a sworn Affidavit, to conduct this recount. The Chairperson, a former Appellate Court Judge, has submitted to the Court that GECOM has made a decision to conduct this recount; she emphasized that GECOM has the constitutional power and mandate to carry out this recount. She reminded the Court that GECOM is an autonomous independent body, exclusively charged with the responsibility to conduct elections. She has pleaded a case for GECOM to be allowed to discharge that mandate and has confirmed that GECOM was in the process of so doing, when injuncted by the Court. She implores the Court to recognize that GECOM must at all times act with fairness and impartiality and that it is imperative that GECOM be allowed to do so in a manner that will continue to inspire public confidence in the electoral machinery and the results generated therefrom.....In such a circumstance, any Court that hinders the resolution of this dispute becomes part of the problem and not the solution. The fair, just and expedient thing for a Court to do in these circumstances, is to hold its hands, while the constitutional institution discharges its mandate"

PRESS STATEMENT

The ultimate objective of any judicial system is to resolve disputes in accordance with law. Any time a Court obstructs, rather than facilitate the resolution of a dispute before it, in any form or fashion, that Court would be departing from its conceptual role and indeed, its constitutional duty. The very survival of Guyana, as a Nation State, being part of the civilized and free world, is currently before the Courts of Guyana.

The quintessential issue of controversy is whether a recount of the ballots cast should be done. The law says that it is a mandatory facility available to any political party desirous of a recount. This request for a recount, made by eight (8) political parties, was denied for the most dubious reasons by a Returning Officer, whose credibility is damaged beyond redemption. Every major local organization has called for this recount. So, have all the political parties contesting the polls, including, the APNU+AFC. Every accredited international Observer Team has done similarly. Almost every diplomatic mission in Guyana and the Governments that they represent have called for this recount. CARICOM has gone as far as brokering an agreement between the President and the Leader of the Opposition to facilitate this recount and in this regard, an Aide Memoire was signed by the nation’s two foremost leaders to give effect to this recount.

The world has said to Guyana that no government, which assumes Office through the current declaration of the Region 4 results, would enjoy legitimacy and that a repertoire of sanctions will be unleashed upon Guyana, and personally against those who aided and abetted in the derailing of democracy at these elections.

Against this backdrop, why would a Court stand in the way of such an imminent resolution of the dispute before it by the authorized constitutional agency? In such a circumstance, any Court that hinders the resolution of this dispute becomes part of the problem and not the solution. The fair, just and expedient thing for a Court to do in these circumstances, is to hold its hands, while the constitutional institution discharges its mandate. After all, no Court has the jurisdiction to give legitimacy to that which is plainly illegitimate.

Inagine if the court operated on the principle that the accused will decide on the judge and jury and even the rules of trial.

What could possibly happen in April? Indications are that the stubborn wrong-strong PNC is ready to swear-in DAG without a GECOM recount. All hell will break loose after that. The ABCE and other countries and the influential OAS and other multilateral forces won't recognize that DAG government. International political and economic pressure will descend on the DAGs.

Perhaps, to show they are accomodating. 

The PPP never will consider inclusive government neither will the PNC, once either is the government. In a fair election, the PPP most likely, always win and NEVER agree to a colalition with the PNC. 

The PNC got a chance at the government, their performance was poor. Knowing that they may NEVER get a chance again. They doan want to loose out on this unique opportunity. 

Oil revenues forces the PNC to be accomodating to the PPP. Otherwise, we all know if the PPP alone get their hands on the money, dey goan tief it all.

Worst for the people of Guyana, this union. 

With the PNC, dem alone would tief it all as the PPP would. But wid both of dem together, fite and murder would be the order of the days. Coalition is for peace, but not with the PPP and PNC.

Both these organization knows ethnically they are the chosen ones, suh most likely without the say of the ppl, dey believe dey have dey blessings for the union.

Together, dey in the money and the ppl can go screw demselves. 

28 years PNC rule din help black ppl.

23 years PPP rule din help Indian ppl, it helped some Black pp.

5 years, PNC rule din help Guyanese.

The future is more bleak than ever, I live in the west, I see progress every day. Both the PNC and PPP lacks the vision.

Siggy, you need to keep up to speed on need and news conferences. Jagdeo clearly stated that the PPP will have an incisive administration and will have consultation with the PNC after the votes are counted and verified by an independent body like the Caricom. He even Went as far as Stating that he is in favour of a full recount of all regions. ABCE want an inclusive administration but only after Region 4 is  verified with all of the SOP counted and for Mingo to stop counting mango.

You know 1992, CBJ said inclusive government he is for and he went about and destroyed GUARD. He created the CIVIC to minimize their role and gave the PPP complete control. Why he din leave GUARD as it was? The PPP wants control, rite down to Ramotar.

This story with the PNC, ABCE, GECOM probably will give unbiased ppl a chance to be heard.

Indos of today are not like yesterday’s Indos. Remember dat Kulie bai who stood up to 20 policemen in Berbice ? You need to move with the times bai. ABCE has made it abundantly clear that the hammer will fall on Granger and PNC head if the try to swear in GrNger illegally. Wake up bai, dis time na Lang time. There are very powerful lobbyists in Washington on behalf of the PPP and the results show.
