The president can ONLY appoint GECOM chairman, unilaterally, if the Leader of the Opposition DID NOT submit a list of candidates.

Does the part that the list has to include people not unreasonable to the president not mean anything to you.

Please note that if Hoyte had submitted people like David Hinds, Eusi Kwayana, Eric Phillips, and others of that ilk, there is NO WAY that Jagdeo would have accepted them.

DG re your point 3...Leader of the opposition resubmits list(s) and president can reject.

So the president rejects the lists...what is the next step?

You have not answered the question I asked....read slowly now.

The President rejects the three lists....what is the next step?

Cain ... the nest step ... read very, very s-l-o-w-ly point 1.

1. Opposition Leader then needs to submit another list.

Now, read point 2. below ...

2. ONLY when the Opposition Leader FAILS to submit a list, THEN the president can unilaterally appoint someone of his choice.

My statement ....

GECOM was established by an amendment to the constitution in 2000.

===========================

Excerpt from GECOM web site ...

GECOM Source --- http://www.gecom.org.gy/elections_commission.html

Guyana Elections Commission (GECOM)

The Guyana Elections Commission (GECOM) is the entity that is responsible for the administration and conduct of elections in Guyana. GECOM is headed by a Chairman and six Commissioners. GECOM is supported by core staff in its Secretariat. The work of the Commission is supplemented in its elections preparation and administration by thousands of temporary staff.

See section 10 of the Election Laws (Amendment) Act No. 15 of 2000.

Appointment of the Chairperson and Commissioners:
Chairperson
The Chairman shall be a person who holds, has held or is qualified to hold the office of Judge of the High Court or the Court of Appeal or any other fit and proper person who is appointed from a list of six persons, who are not unacceptable to the President, submitted by the Leader of the Opposition after he has meaningfully consulted with the non-governmental political parties represented in the National Assembly. If the Leader of the Opposition does not submit such a list of persons then the President shall appoint a person who holds, has held or is qualified to hold the office of Judge of the High Court or the Court of Appeal. The current Chairman of the Commission was chosen by the President from a list of six persons submitted by the Leader of the Opposition.

You post this and forget to read about the fact that the list has to include people who are NOT UNACCEPTABLE to the president.

In the event that the list does not include people who are acceptable to the president then he can act unilaterally.  The word "such" a list means quite a lot and certainly doesn't suggest that the president is forced to select from any 6 people who the opposition decides that it wants.

Thank you for posting this!

The constitution is quite clear on the process as noted in my comments.

The issues regarding Hoyte, Hinds, etc., are irrelevant to the specific item on the appointment of GECOM chairman.

Continuation and specific reference...

If the Leader of the Opposition does not submit such a list of persons then the President shall appoint a person who holds, has held or is qualified to hold the office of Judge of the High Court or the Court of Appeal.

So let us examine this. The word "such" means that a list can be provided but if it isn't a list that includes people who are seen as "reasonable" then the list is irrelevant.

"Such a list" is different from "a list".  I hope that you can see this.

You really ought to scream that Jagdeo be dumped because this is the opening that he allowed Granger to run through and some day someone will point this out!

Absolutely INCORRECT that it is Jagdeo's constitution.

The constitution was developed by FORBES BURNHAM.

My dear sir YOU said that the insertion of this GECOM chairman part was an amendment by Jagdeo.

You are incorrect again.

The permanent establishment of GECOM was made in 2000.

Prior to 2000, the Commission ONLY met before an election is held and then dis-banned about three month after the election.

When GECOM became a permanent organisation in 2000, Desmond Hoyte, as opposition leader submitted names -- which included David Granger on two occasions -- from which a chairman was selected.

the PPP was quite happy with the state of affairs for 23 years.

They did NOTHING. They could have mobilized public opinion against the constitution, forcing the PNC to participate. Not only did they NOT do so but Jagdeo even praised the constitution as being the best in the Caribbean, after he made a few cosmetic changes.

The PPP owns this constitution as much as the PNC does.

Please note that Jagdeo didn't accept David Granger, but you expect the latter to accept Ryhaan Shah!

Those are people of questionable character, Eusi was involved in a plot to kill Burnham during Rodney days. Hinds is another hater of Indians and make up stories daily denigrating the other half of Guyana's population. Philips is another jackass who hates Indos like you do with a passion.

The constitution is quite clear that the Leader of the Opposition must submit a list to the president from which a person should be chosen.

.

Please post where it says that Granger must chose from Jagdeo's list.

It specifically says that if the president doesn't think that the list is suitable, and note that all that is needed is the president to think that it isn't suitable,  then he can chose his own, based on certain criteria.

Dragging up what the PPP did, in an era when they thought it impossible that they would ever lose an election, because of our ethnic demographics, is irrelevant.

You can continue trying to make these two understand simple English. I am done. I don't have time to waste.

What should the president, any president, do if he finds the names presented by the opposition, any opposition, to be unacceptable?

Would the Rat present anyone who could be considered remotely impartial?

And Ryhaan Shah has displayed extreme hatred of blacks so cannot be objective, yet Jagdeo selected that creature.

Your boy wanted a crisis so that he can pretend that he cares about democracy. Yes this man who consorted with people who had ties to the Colombia cartel, one of whom allegedly killed one of his own ministers.

Sat Sawh's family have been peddling this and claim that Sawh refused a forestry concession to RK because he knew that the criminal would use it to ship his drugs. So Jagdeo's best buddy RK got rid of him.

That is the story that the man's family tells.

Jagdeo screamed that he knew who master minded the killing, yet never had them arrested?  Did you think that not odd?

1. Indeed a few cosmetic changes were made because they require just a majority-vote to do so.

2. Records and information show clearly that for the major changes to take effect, it requires as a minimum two-thirds of the MPs.

3. Since the rigging of elections in Guyana which were confirmed publicly by international organizations; Burnham "obtained" more than sixty six percent of the MPs to implement those changes to the constitution.

4. Composition now is 52 and 53 members for the PPPC and PNCR/AFC respectively.
